Restriction on lawyers' social media! A special monitoring center is being established.

With the new regulation of the Turkish Bar Association, restrictions are imposed on lawyers' social media posts, a special monitoring center will be established to supervise advertising ban violations, and disciplinary penalties will be applied to violators.

With the amendment to the Turkish Bar Association Advertising Regulation published in the Official Gazette, new restrictions have been imposed on lawyers' posts on social media and digital platforms. A special monitoring mechanism will be established to detect those who violate the advertising ban.

“ADVERTISING VIOLATION MONITORING CENTER” IS BEING ESTABLISHED

Under the new regulation, a “Advertising Violation Monitoring Center” consisting of 5 people will be established to monitor violations of the advertising ban. This center will examine claims of violations in written, visual, and online media, report to the Turkish Bar Association, and follow the process before the bar associations. Members of the center will be appointed by the Turkish Bar Association Board of Directors for a maximum of two years and must not have received any disciplinary penalties.

RESTRICTIONS ON SOCIAL MEDIA POSTS

According to the regulation, lawyers cannot advertise through past or ongoing cases, nor make statements acting as the spokesperson for the parties. Posts of an advertising nature about their lives, earnings, or activities in connection with their professional identity are also included in the ban. Additionally, the use of redirecting codes, keywords, and similar methods to achieve higher rankings in search engines on websites and digital platforms is also prohibited.

EMPHASIS ON PROFESSIONAL REPUTATION

The regulation emphasizes that lawyers must avoid actions that damage the reputation of the profession, even in posts related to their private lives.

DISCIPLINARY PENALTIES WILL BE APPLIED

Within the scope of the previously enacted 11th Judicial Package, various amendments were made to the Attorneyship Law. These regulations paved the way for warnings, reprimands, and disciplinary penalties to be applied to lawyers who violate professional rules. Violation of the advertising ban, acts against professional honor, practices that increase competition among colleagues, and statements exceeding legal boundaries were also included in the scope of discipline.
