The family of footballer Kubilay Kaan Kundakcı, killed in an armed attack in Ümraniye, requested the return of the indictment, claiming the charges against the suspect are incorrect.
A petition was submitted to the court regarding the indictment prepared for the murder of Kubilay Kaan Kundakçı, who lost his life in an armed attack on March 19 in Ümraniye. In the petition submitted through the family's lawyer, it was argued that the legal characterization of the crime against the suspect was erroneous, and the return of the indictment was requested.
"THE CRIME SHOULD BE 'MURDER BY PREMEDITATION' NOT 'INTENTIONAL KILLING'"
In the indictment prepared as part of the investigation conducted by the Istanbul Anatolian Chief Public Prosecutor's Office, while the suspect was requested to be punished for the crime of "intentional killing," the victim's family objected to this assessment. The objection argued that the incident should be evaluated under "murder by premeditation."
"THE INCIDENT WAS PLANNED" WAS STATED
According to the statements in the petition, it was stated that the suspect's firearm was ready to fire at the time of the incident, that he carried out the act shortly after getting out of the vehicle, and that this situation was supported by camera recordings. Therefore, it was emphasized that the act was not spontaneous but planned.
On the other hand, it was also argued that including rapper Vahap Canbay and producer Yalçınay Yıldız, who were in the vehicle during the incident, only as "witnesses" in the file was erroneous. It was stated that the suspect's target was Vahap Canbay and that these two individuals should be assessed under the scope of "attempted intentional killing."
In the application submitted to the court by the complainant's representative, it was emphasized that the evaluations made during the investigation phase were incomplete and erroneous, and the return and revision of the indictment were requested.
FROM THE INDICTMENT
In the indictment prepared by the Anatolian Chief Public Prosecutor's Office, according to the expert examination of security camera footage, it was described that two vehicles pulled up in front of the vehicle containing the deceased Kubilay Kaan Kundakçı, and the suspect Alaattin Kadayıfçıoğlu, getting out of the vehicle, removed a firearm from his waist, opened the front passenger door of the victim's vehicle, and opened fire.
In the indictment, it was stated that the single bullet that hit Kundakçı caused a fatal injury, and the Forensic Medicine Report indicated that the bullet caused internal bleeding due to internal organ and major vessel injuries, leading to death.
The indictment included the testimony of Yalçınay Yıldız, who was in the vehicle during the incident, as a witness. In his testimony, Yıldız stated that Aleyna Tutuş (Kalaycıoğlu), with whom he had a video call before the incident, used threatening language during the call.
Witness Yıldız recounted that during the attack, suspect Kadayıfçıoğlu opened the vehicle door saying, "I will not see you here again," and immediately fired his weapon.
Yıldız stated that the injured Kundakçı held his abdomen saying, "I've been hit," and that the assailants fled the scene in two vehicles.
In the indictment, it was noted that expert reports examined vehicle movements and phone traffic, and that there was strong suspicion that the suspects arrived at and left the area hours before the incident, and that the attack might have been planned rather than spontaneous.
HTS records, mobile phone examinations, and criminal reports indicated intense communication among the suspects before the incident and that some contacts continued afterward.
REQUEST FOR LIFE IMPRISONMENT FOR 3 SUSPECTS
In the prepared indictment, it was requested that suspect Alaattin Kadayıfçıoğlu be sentenced to life imprisonment for "intentional killing," and suspects Aleyna Tutuş and Zuhal Kalaycıoğlu be sentenced separately to life imprisonment for "incitement to intentional killing."
In the indictment, it was further requested that suspects Hüseyin Can Avcı, Mustafa Rece, and Bilal Kadayıfçıoğlu be punished with 10 to 15 years in prison for "aiding intentional killing," and Metin Kadayıfçıoğlu be sentenced to 1 to 10 years in prison for "destroying, concealing, or altering evidence of a crime" and "harboring a criminal."
For suspect Engin Taşkıran, a prison sentence of 6 months to 10 years was requested for "harboring a criminal" and "destroying, concealing, or altering evidence of a crime."
In the indictment, it was also requested that suspects İzzet Yıldızhan and Ahmet Özkoç be sentenced to 6 months to 5 years in prison for "harboring a criminal."
WHAT HAPPENED?
On March 19, on Sıddık Street in Tatlısu Neighborhood, Kundakçı, who was sitting in a parked vehicle with a friend, was seriously injured when one of the suspects who arrived at the scene in two vehicles opened fire, and he died in the hospital after being taken there.
Following the incident, as part of the investigation initiated by the chief public prosecutor's office, suspects Alaattin Kadayıfçıoğlu, Aleyna Tutuş (Kalaycıoğlu), Hüseyin Can Avcı, Mustafa Rece, Metin Kadayıfçıoğlu, Engin Taşkıran, and İzzet Yıldızhan were arrested by the duty magistrate's court.
Suspects Zuhal Kalaycıoğlu and Ahmet Özkoç were released under judicial control conditions.
