In the case involving the incident where police officer Murat Akpınar was shot with a shotgun while intervening in a fight at a café in Kayseri and later became a martyr 34 days later, security camera footage has emerged in the trial with 8 defendants. The Regional Court of Appeals overturned the local court's decision, stating that the sentence given to the defendant Adnan Tosun, who received 40 years and 10 months in prison, was too lenient. The case will be re-examined in the local court and has been postponed.

On August 13, 2022, Adnan and Muhammet Tosun brothers came to the café where Mehmet and Mustafa Coşkun brothers were located in the Sanayi neighborhood of Kocasinan district in Kayseri.

THEY INJURED TWO POLICE OFFICERS AND FLED

A dispute arising from a debt issue between the two groups turned into an armed fight. During this time, police teams on patrol intervened in the fight and tried to separate the parties. Adnan Tosun, who fired with a shotgun, injured police officer Murat Akpınar in the chest and Mustafa Coşkun in the arm and fled.

VERDICT HEARING

In the verdict hearing of the case seen on March 22 last year at the Kayseri 2nd High Criminal Court, the court panel sentenced the suspect Adnan Tosun to 25 years in prison for the crime of 'intentional killing with probable intent'. The panel also sentenced him to 7.5 years for 'attempting to kill' against Mustafa C., 6 years and 4 months for the same crime against Memet C., and 2 years for the crime of 'injury' against Celil T. Thus, Adnan Tosun was sentenced to a total of 40 years and 10 months in prison. The panel ruled for the acquittal of Muhammet Tosun for the crime of 'instigating killing'. The court sentenced Halil T., one of the suspects released without detention, to 1 year and 4 months in prison for the crime of 'threat with a weapon'. The court imposed various monetary penalties on the other 5 suspects for the crime of 'simple injury with a weapon'.

THE APPEAL COURT ANNOUNCED A REVERSAL DECISION

The lawyers of the suspect and the complainant appealed the decision and brought the case to the Kayseri Regional Court of Justice. After reviewing the case, the 1st Criminal Chamber issued a reversal decision on the grounds that the prison sentence given to suspect Adnan Tosun for 'intentional killing with probable intent' was too lenient. The Criminal Chamber stated that the crime fell under the scope of 'intentional killing with probable intent against a public official', and therefore the sentence should be increased, and a new ruling should be established. The suspects, who appeared before the judge again yesterday at the Kayseri 2nd High Criminal Court, reiterated their previous defense and requested their acquittal. The court panel postponed the hearing to address the deficiencies.
