The 'Draft Law on Strengthening National Solidarity and Social Integration', which is intended to form the legal framework for the Terror-Free Turkey process and is referred to in the public as the 'framework law', was accepted in the General Assembly of the Turkish Grand National Assembly. All 12 articles of the draft were accepted in the vote with 468 'yes' votes against 88 'no' votes and 6 'abstentions'.

The draft law titled 'Law on Strengthening National Solidarity and Social Cohesion', which is intended to form the legal framework for the Türkiye Without Terrorism process and is publicly referred to as the 'framework law', was accepted in the Turkish Grand National Assembly (TBMM) General Assembly.

468 YES, 88 NO, 6 ABSTENTIONS

After all 12 articles of the draft were accepted individually, the entire draft was put to a vote in the General Assembly.

In the vote, 468 deputies voted 'yes', 88 deputies voted 'no', and 6 deputies voted 'abstention'.

Thus, the 12-article framework law draft was accepted in the TBMM General Assembly and became law.

CONDITION FOR PKK/KCK'S DISARMAMENT AND DISSOLUTION

The first article of the draft determines the purpose and scope of the regulation. Accordingly, security institutions must determine that the PKK/KCK and its affiliated structures have ended their de facto existence and have surrendered all weapons and ammunition under their control, and this determination must be confirmed by the National Security Council (MGK) and published in the Official Gazette.

The regulation covers establishing or managing the PKK/KCK, being a member of the organization, knowingly and willingly aiding it, making propaganda for the organization, crimes committed within the scope of organization activities, and crimes related to the financing of terrorism committed in favor of the organization.

DEFINITIONS MADE FOR THE ORGANIZATION AND THE BOARD

The second article of the draft defines the basic concepts to be used in the law. Accordingly, the term 'organization' refers to the PKK/KCK and all its affiliated structures, while the term 'Board' refers to the board to be established within the scope of the 7th article of the draft.

SOME INVESTIGATIONS AND PROSECUTIONS WILL BE DEFERRED

With the third article, it is envisaged that investigations and prosecutions regarding certain crimes will be deferred if it is determined and confirmed by the MGK that the PKK/KCK has laid down its arms and ended its de facto existence.

The crime of intentional killing committed within the scope of organization activities, and crimes committed before June 1, 2005, requiring life imprisonment or aggravated life imprisonment, are excluded from the scope.

For other crimes falling within the scope of the law, investigations and prosecutions related to crimes requiring a prison sentence of 15 years or less will be deferred for 5 years, while those related to crimes requiring more than 15 years of imprisonment, life imprisonment, or aggravated life imprisonment will be deferred for 10 years.

During the deferral period, the statute of limitations for prosecution will not run. During this period, files and evidence related to the relevant crimes will be preserved.

DETENTION AND JUDICIAL CONTROL DECISIONS WILL BE RE-EVALUATED

With the fourth article, the re-evaluation of detention and judicial control decisions issued due to crimes falling within the scope of deferral is regulated.

If the conditions are met, the relevant judge or court may decide to lift these measures. It is also envisaged that a reversal decision will be issued regarding files at the appeal or cassation stage.

IF A NEW TERROR CRIME IS COMMITTED, THE DEFERRAL WILL BE LIFTED

Deferral decisions issued within the scope of the fifth article will be recorded in a special system. These records can only be used upon the request of the public prosecutor, judge, or court in connection with the relevant investigation or prosecution.

If a new terror crime is committed during the deferral period, the deferral decision will be lifted, and the investigation or prosecution will continue. In case of conviction, the sentence given will not be deferred within the scope of the 6th article.

If the specified period is completed without committing any terror crime, a decision of no need for prosecution or dismissal of the case will be made.

EXECUTION OF CONVICTS' SENTENCES WILL ALSO BE DEFERRED

With the sixth article, the deferral of the execution of sentences for convicts meeting certain conditions is regulated.

Those convicted of intentional killing committed within the scope of organization activities, and those sentenced to life imprisonment or aggravated life imprisonment for crimes committed before June 1, 2005, are excluded from the scope.

The execution of sentences for those sentenced to 15 years or less of imprisonment for crimes within the scope can be deferred for 5 years, while the execution of sentences for those sentenced to more than 15 years of imprisonment, life imprisonment, or aggravated life imprisonment can be deferred for 10 years.

If a terror crime is committed during the deferral period, the execution judge will lift the deferral decision and decide to continue the execution of the sentence. If the period is completed without committing a new crime, the sentence will be considered executed.

A BOARD WILL BE ESTABLISHED TO MONITOR THE PROCESS

With the seventh article of the draft, a Board will be established to monitor and evaluate the implementation of activities within the scope of the law.

The Vice President will chair the Board. The Board will include the Ministers of Justice, Foreign Affairs, Interior, and National Defense, the Secretary General of the Presidency, the Head of the National Intelligence Organization, and the Secretary General of the National Security Council.

The Board may form sub-commissions when necessary and may invite ministries, institutions, organizations, or individuals it deems necessary to its meetings.

The process regarding the complete liquidation of the PKK/KCK will also be evaluated periodically by the Board. If deemed necessary, requests can be made regarding judicial, administrative, and legal regulations.

The Board will also regularly report its activities to the TBMM. The Speaker's Office will also establish a Monitoring Commission to monitor activities within the scope of the law.

WEAPONS AND AMMUNITION WILL BE REGISTERED

With the eighth article, it is stipulated that weapons, ammunition, vehicles, equipment, explosives, and other materials brought by or declared by organization members will be registered.

The procedures and principles for these transactions will be determined by the Ministry of Interior and the Ministry of National Defense, taking the opinions of security institutions.

6-MONTH PERIOD FOR APPLICATION

According to the ninth article, those who wish to benefit from the provisions of the law must apply in writing within 6 months following the publication of the MGK decision in the Official Gazette, to the chief public prosecutor's offices where they are located or to institutions designated by the Board.

EXEMPTION FROM LIABILITY FOR THOSE FULFILLING THE DUTY

With the tenth article, it is regulated that the duties assigned within the scope of the law will be fulfilled urgently by the relevant public institutions and organizations.

In this context, it is stipulated that persons who fulfill the duties assigned in line with the purpose and activities of the law will not incur legal, administrative, or criminal liability due to these duties.

THE LAW WILL ENTER INTO FORCE ON THE DAY OF PUBLICATION

The eleventh article of the draft includes the entry into force regulation. Accordingly, the law will enter into force on the date of its publication.

The twelfth and final article states that the provisions of the law will be executed by the President.
