The first hearing of the case regarding the death of Oğuz Murat Aci in an accident involving unlicensed driver Timur Cihantimur in Eyüpsultan on March 1, 2024, is being held today. The defendant Cihantimur will not be able to attend the hearing as the extradition process has not been completed.
The trial regarding the accident in Eyüpsultan on March 1, 2024, involving unlicensed driver Timur Cihantimur, who was 17 years old at the time, resulting in the death of Oğuz Murat Aci, begins today. It has been learned that Cihantimur, whose extradition process has not yet been completed, will not be able to attend the hearing.
On March 1, 2024, in Eyüpsultan, unlicensed driver Timur Cihantimur, who was 17, while driving, collided with three ATV-type vehicles parked on the roadside due to a malfunction. As a result of the accident, 29-year-old Oğuz Murat Aci lost his life, and other individuals present were injured. After the accident, Cihantimur's mother, Eylem Tok, allegedly, along with individuals including father Bülent Cihantimur, cooperated to remove her son from the accident scene and smuggled him abroad. The investigation into Timur Cihantimur regarding the incident has been completed, and it has been requested that he be sentenced to between 1 year and 9 months and up to 12 years in prison for the crime of 'causing death and injury by conscious negligence,' considering he was 17 at the time of the incident. Meanwhile, a red notice request has been issued for Cihantimur, and his extradition from the USA is awaited.
FIRST HEARING TODAY
The first hearing of the case related to the incident will be held today. The hearing, to take place at the Gaziosmanpaşa 4th Heavy Penal Court at 13:30, it has been learned that the defendant Cihantimur, whose extradition process is not yet complete, will not be able to attend, and some individuals will be heard as 'witnesses.'
FROM THE INDICTMENT
In the indictment prepared by the Istanbul Chief Public Prosecutor's Office and sent to the Gaziosmanpaşa Chief Public Prosecutor's Office, Oğuz Murat Aci was listed as the 'deceased,' İbrahim Gümüş and Tahsin Arslan as 'victims,' Özer Aci as 'complainant,' Şükriye Aci as 'the injured party,' and Timur Cihantimur as 'the child pushed into crime.'
STATED AS PRIMARILY AT FAULT
In the prepared indictment, considering the damage to the ATV vehicles after the accident, it was stated that the child pushed into crime, Timur Cihantimur, caused the traffic accident while driving his vehicle at a speed well above the legal speed limit, that Cihantimur was primarily at fault, and that the off-road vehicles that had stopped due to a mechanical breakdown were secondarily at fault.
IT WAS REPORTED THAT NO ALCOHOL TEST COULD BE CONDUCTED BECAUSE HE FLED AFTER THE INCIDENT
In the indictment, where it was stated that Timur Cihantimur had fled after the incident, it was reported that for this reason, an alcohol breath test could not be performed on Cihantimur, and that no driver's license had been issued in Cihantimur's name. Additionally, it was noted that after the accident, the 'S.O.S.' system in Cihantimur's car was activated, calling the 112 emergency line, and that the 112 operator tried to communicate with the individuals inside the vehicle but was unsuccessful.

In the indictment, it was reported that driver Timur Cihantimur, aged 17 and without a driver's license, entered a curve with a current maximum speed limit set at 30 km/h, lacking lighting, and with speed bumps, at high speed. According to witness statements, although vehicles in traffic slowed down, he did not reduce his speed, overtaking them; despite warnings from friends in the car to slow down, he continued driving without reducing his speed; and under these conditions, while proceeding at this speed on a road with a 30 km/h limit, he foresaw that he could cause an accident at any moment but did not desire the outcome, yet continued driving and caused the accident primarily and faultily by colliding with ATV vehicles on the roadside.
REQUEST FOR UP TO 12 YEARS IN PRISON
In the prepared indictment, it was requested that the child pushed into crime, Timur Cihantimur, be sentenced to between 1 year and 9 months and up to 12 years in prison for the crime of 'causing death and injury by conscious negligence,' considering he was 17 at the time of the incident.
