The 15-year prison sentence given to Ferhat Bingöl, who opened fire with a shotgun at his ex-wife Aysel Aydemir, for whom a protection order had been issued in İzmir Çiğli, and shot her in the legs with a pistol when the shotgun jammed, was overturned by the Court of Cassation. The Court of Cassation ruled that the defendant should be retried for the offense of 'aggravated injury by consequence' rather than attempted murder, noting that he shot her in the legs although he had the opportunity to fire at vital areas.
In the Çiğli district of İzmir, the 15-year prison sentence given to Ferhat Bingöl (43), who tried to shoot his ex-wife Aysel Aydemir (39) with a shotgun but, when the shotgun jammed, pulled a handgun from his waist and shot her in the legs, for the offense of 'attempted intentional killing of a spouse,' was overturned by the Court of Cassation. The Court of Cassation found it unlawful for the defendant to be sentenced for the offense of 'qualified attempted intentional killing' because he shot at the leg area even though he had the opportunity to fire while targeting vital areas. It was decided that the attacker should be retried for the offense of 'injury with aggravated consequences.'
WHEN THE SHOTGUN JAMMED, HE PULLED OUT THE HANDGUN
In the Çiğli district, Aysel Aydemir, a mother of two, left home at around 06:30 on 19 June 2023 to go to work. At that time, Ferhat Bingöl, whom she had divorced five years earlier and obtained a protection order against, came up to Aydemir with a shotgun and, after saying 'So you're reporting me,' opened fire. Ferhat Bingöl, who then aimed at Aydemir's head, had his shotgun jam. Thereupon, Ferhat Bingöl took out his unlicensed handgun from his waist, shot Aydemir in the legs, and fled. The injured Aysel Aydemir was taken to hospital by ambulance. Ferhat Bingöl, who was detained, was arrested, while Aysel Aydemir was discharged after treatment.
THE CASE WAS MOVED TO THE HEAVY CRIMINAL COURT
In light of the statements and collected evidence, the prosecutor sought a prison sentence of up to 12.5 years in total for Ferhat Bingöl for the offenses of 'intentional injury against a divorced spouse,' 'threatening with a weapon,' and 'violating Law No. 6136 on Firearms, Knives and Other Tools.' The indictment was accepted by the Karşıyaka 2nd Criminal Court of First Instance. However, upon the lawyers' objections, the case file was sent to the Karşıyaka 3rd Heavy Criminal Court. At the verdict hearing held in 2024, the court panel sentenced Bingöl to 15 years in prison for the offense of 'attempted intentional killing of a spouse' and to 2 years in prison and a fine of 1,200 TL for the offense of 'violating Law No. 6136 on Firearms, Knives and Other Tools.' No reduction was made in Bingöl's sentence.
COURT OF CASSATION: HE HAD THE OPPORTUNITY TO FIRE AT VITAL AREAS
Upon objections, while the case was going to appeal, the Criminal Chamber that examined the case did not find the parties' grounds for objection justified and rejected them. Thereupon, the case was taken to the Court of Cassation. The 1st Criminal Chamber of the Court of Cassation stated that the defendant injured Aysel Aydemir in the right leg and left knee area and fled by ending his action 'on his own.' It was stated that although there was no serious obstacle to using a handgun suitable for killing, the defendant fired at the leg area even though he had the opportunity to fire from a close and effective distance while targeting the vital areas of Aysel Aydemir, who was in a fallen position.
For these reasons, it was decided that imposing a penalty for the offense of 'qualified attempted intentional killing' by falling into an error regarding the qualification of the offense was found to be unlawful. The Criminal Chamber, deciding that the defendant should be sentenced for the offense of 'injury with aggravated consequences,' overturned the decision and sent the case file back to the local court. Defendant Bingöl will be retried at the Karşıyaka 3rd Heavy Criminal Court.
