The 12-article framework law proposal aimed at establishing the legal basis for the Türkiye without Terrorism process was accepted in the TBMM Justice Commission after 18 hours of deliberations. The regulation, which provides for postponements of trial and execution, political bans, the exclusion of certain crimes from the scope, and the establishment of new boards for the supervision of the process, will be discussed in the TBMM General Assembly tomorrow.
The bill prepared for the Terror-Free Türkiye process, submitted to the Speaker's Office of the Grand National Assembly of Türkiye on Wednesday, August 5, with the signatures of 360 deputies, was accepted in the TBMM Justice Commission on August 8. The discussions in the commission lasted approximately 18 hours.
Attention has now turned to the TBMM General Assembly where the bill will be discussed. The regulation will come to the General Assembly's agenda tomorrow.
THE BILL CONSISTS OF 12 ARTICLES
The bill, which aims to put the Terror-Free Türkiye process on a legal footing, consists of a total of 12 articles. The regulation covers establishing or leading the PKK/ KCK, being a member of the organization, aiding the organization, organization propaganda, and crimes committed within the scope of the organization's activities.
DISARMAMENT MUST BE CONFIRMED FIRST
For the regulation to be implemented, the condition regarding the organization's disarmament and dissolution process must be fulfilled at the first stage.
The bill stipulates as a precondition that the National Security Council's decision on the dissolution of the terrorist organization be published in the Official Gazette. Following the completion of this stage, the provisions stipulated in the law will begin to be implemented.
THE LAW WILL BE IN EFFECT FOR 6 MONTHS
After the NSC's decision on the dissolution of the terrorist organization is published in the Official Gazette, a 6-month period will begin for those who wish to benefit from the regulation. It is envisaged that those who wish to benefit from the regulation will be able to utilize the relevant provisions within this period.
TRIALS WILL BE POSTPONED
According to the framework bill, different postponement periods will be applied in trials based on the prison sentence required by the crime. Trials for crimes requiring a prison sentence of 15 years or less will be postponed for a period of 5 years.
For crimes requiring a prison sentence of more than 15 years, it is envisaged that trials will be postponed for a period of 10 years.
5 AND 10-YEAR POSTPONEMENTS IN PENAL EXECUTIONS
The bill also includes postponement provisions for individuals who have finalized prison sentences.
According to the regulation, 5 and 10-year postponement periods will be applied in the execution of sentences, depending on the amount of the sentence.
If a "terror crime" is committed again within the postponement period, the postponement decision will be revoked.
2 TO 3-YEAR POLITICAL BAN
There is also a provision regarding political rights for individuals who benefit from the regulation.
According to the bill, individuals who benefit from the regulation will be subject to a political ban ranging from 2 to 3 years.
SOME CRIMES WILL BE EXCLUDED
The bill excludes certain serious crimes committed within the scope of organization activities from the regulation.
Intentional homicide committed within the scope of organization activities and crimes committed before June 1, 2005, requiring life or aggravated life imprisonment will not be included within the scope of the regulation.
ABDULLAH ÖCALAN WILL NOT BENEFIT FROM THE REGULATION
It is stated that due to the provisions regarding excluded crimes in the bill, PKK terrorist organization leader Abdullah Öcalan will not be able to benefit from the said regulation.
In this respect, the regulation also includes limits regarding the PKK's executive cadre.
A BOARD WILL BE ESTABLISHED UNDER CEVDET YILMAZ
The bill includes not only trial and execution provisions but also new mechanisms for monitoring and auditing the process.
A board will be established under the chairmanship of Vice President Cevdet Yılmaz to ensure the monitoring, auditing, and coordination of the process.
A 17-MEMBER MONITORING COMMISSION WILL BE ESTABLISHED IN PARLIAMENT
The regulation also envisages the establishment of a separate structure within the TBMM to monitor the process.
The monitoring commission to be established in Parliament will have 17 members. The commission will be tasked with monitoring the process to be carried out within the scope of the law.
CRIMINAL LIABILITY REGULATION FOR PUBLIC OFFICIALS
The bill also includes a provision regarding public officials who will take part in the execution of the process.
It is envisaged that public officials operating within the scope of the law will not have criminal liability for the transactions they carry out.
Following the 18-hour discussions in the Justice Commission, the process for the 12-article bill will now continue in the TBMM General Assembly.
