While the repercussions of the investigation launched regarding the claim that Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu's university diploma is fake continue, the Istanbul Chief Public Prosecutor's Office has sent a request to Istanbul University for action to be taken regarding the diploma.

WILL THE MAYORALTY BE REMOVED?

As discussions continue, it has also begun to be wondered whether the Istanbul Metropolitan Municipality Mayor's position would be vacated in the event of the cancellation of İmamoğlu's diploma. According to research conducted; a person must have at least a primary school diploma to be able to become a mayor. In this case, there is no issue regarding İmamoğlu's continuation as the metropolitan mayor in the event of a possible diploma cancellation.

To be able to become a Metropolitan Mayor, the following conditions must be met according to Law No. 2972 on Local Authorities and the Elections of Neighborhood Mukhtars and Elderly Councils and other relevant legislation;

1. Must Be a Turkish Citizen

  • Candidates must be citizens of the Republic of Turkey.

2. Must Have the Qualifications to Be Elected

  • Must be at least 18 years old
  • Must not be restricted (incapacitated)
  • Must not be banned from public services
  • Must not have received a prison sentence of one year or more, excluding negligent crimes
  • Must not have committed disgraceful crimes (embezzlement, bribery, theft, fraud, etc.)

3. Must Have at Least a Primary School Diploma

  • Candidates must have at least a primary school diploma to be able to become a mayor.
  • 4. Must Meet the Conditions for Participation in Elections and Candidacy
  • Can participate in the election as a candidate of a political party or as an independent candidate.
  • For political party candidates, it is necessary to have completed the internal candidate determination processes.
  • Independent candidates must complete the signature collection or application processes set forth.

5. Resignation Requirement for Public Officials

  • Public officials such as judges, prosecutors, military personnel, civil servants, and municipal employees must resign to be able to become candidates.

6. Must Be a Candidate in the Election District

One can be a candidate in any metropolitan municipality across Turkey, but it is not mandatory to be registered in the voter registry.

PROSECUTOR'S OFFICE SENT A LETTER TO THE RECTORATE

In the letter sent to Istanbul University regarding the investigation opened against İmamoğlu for the crime of "forgery in official documents" based on the claim that his university diploma is fake, it was requested that necessary actions be taken as soon as possible to ensure that the operations to be established based on İmamoğlu's diploma are not unlawful.

In the letter written by the Chief Public Prosecutor's Office, it was stated, "It has been determined that the administrative processes regarding recognition, horizontal transfer quotas, announcement periods, and acceptance of horizontal transfers by the Dean's Office of the Faculty of Business Administration of Istanbul University have been carried out contrary to the decisions of the Higher Education Council, and it has been continued to use the diploma in question (such as the Supreme Election Council, etc.), in this context, necessary actions should be taken as soon as possible to ensure that the operations to be established based on the diploma are not unlawful, considering the irreparable legal consequences that may arise from the use of the diploma in question as per the report sent by the Istanbul University Rectorate, and if there is an ongoing administrative investigation, the investigation reports in question should be sent to our Chief Public Prosecutor's Office," it was expressed.

"IDENTIFY WHO MADE THE HORIZONTAL TRANSFER"

The letter also requested that all documents related to Ekrem İmamoğlu's education at Istanbul University and the identification of who carried out the processes for the acceptance of the horizontal transfer on September 12, 1990, be determined and sent.

INVESTIGATION

The Istanbul Chief Public Prosecutor's Office had launched an investigation for the crime of "forgery in official documents" based on reports that İBB President Ekrem İmamoğlu's bachelor's diploma is fake and findings in the report prepared by the Higher Education Council regarding the falsity of his diploma. İmamoğlu had been invited to the prosecutor's office to give his statement as part of the investigation.
