The appeal against the 'no grounds for prosecution' decision regarding 22 suspects in the assassination of Sinan Ateş has been rejected. Following the decision, Ateş's family's lawyer announced that they would go to the Constitutional Court.
The President of the Old Idealist Hearths Education and Culture Foundation and Hacettepe University Faculty Member Assoc. Prof. Dr. Sinan Ateş's assassination case has seen an appeal against the decision of non-prosecution given for 22 suspects, including former MHP Member of Parliament Olcay Kılavuz, rejected.
The Ankara Chief Public Prosecutor's Office had issued a decision of non-prosecution in January regarding the investigation into the assassination of Sinan Ateş, which included 22 individuals, among them former MHP MP Olcay Kılavuz and the General President of the Idealist Hearths, Ahmet Yiğit Yıldırım, for the crimes of "intentional murder" and "instigation to intentional murder."
APPEAL AGAINST THE NON-PROSECUTION DECISION
In response, Sinan Ateş's family's lawyer, Şeyda Şahin, had appealed against the non-prosecution decision given by the Ankara Chief Public Prosecutor's Office.
REJECTED
The Ankara 1st Criminal Court of Peace rejected the appeal, stating that the decision of non-prosecution was in accordance with procedure and law. Lawyer Şeyda Şahin announced that they would make an individual application to the Constitutional Court against this decision.
WHAT HAPPENED?
Non-prosecution decisions were issued for suspects Ali Kadir Sarıkaya, Cengiz Tekin, Damla Yüce, Dilek Bilgin, Emin Uzunlar, Erol İnce, Gülşen Kurt, Havva Köktürk, Murat Kurt, Mustafa Kemal Aygün, Ahmet Yiğit Yıldırım, Naim Güneş, Olcay Kılavuz, Tayfun Balaban, Ömer Şanlı, and Veli Küçük Erturan. The decision stated that although an investigation had been initiated against the suspects for participation in murder, there was no concrete evidence that they acted together with other suspects against whom public prosecution had been initiated and that they had carried out the act of the crime.
It was reported that there was no concrete evidence indicating a reasonable suspicion of committing the crime of aiding a criminal for Olcay Kılavuz, leading to the decision of non-prosecution.
