AK Party Parliamentary Group Chairman Abdullah Güler announced at the Grand National Assembly of Turkey a 9-article bill concerning the funds in the liquidation process. Under the bill, investors whose net investment amount is below 1 million lira will receive the entire amount, while those with 1 million lira or more will receive an interim payment of at most 1 million lira. Emphasizing that no public resources will be transferred to the process, Güler said, 'No one will get away with whatever they have done. Even if they are in our party, we will do what is necessary to the very end.'

Following the fund investigation, the legal regulation concerning the funds taken into liquidation came to Parliament. The bill paves the way for advance payments of up to 1 million lira per investor.

“A TEMPORARY, EXCEPTIONAL REGULATION”

AK Party Group Chairman Abdullah Güler, who explained the bill to members of the press at the Grand National Assembly of Turkey (TBMM), stated that 131 funds in liquidation make up 4.6 percent of the total funds in the system. Emphasizing that the regulation is a “temporary, exceptional regulation,” Güler said, “This does not mean we will ignore it.”

Arguing that there is no problem in the capital markets, Güler said, “The investor’s right will be protected. We will tear this virus out of the body.”

“THERE WILL BE NO CONTRIBUTION FROM THE TREASURY”

Güler, who stated that the liquidation process will be carried out with the funds’ own assets, said, “Under no circumstances will public resources be used.” Güler also noted that the bill and the decisions of the Capital Markets Board (SPK) will not include any contribution from the Treasury.

ADVANCE PAYMENT OF UP TO 1 MILLION LIRA

According to information conveyed by Anadolu Agency, the bill envisages that the assets of 455,578 investors be liquidated and distributed to them up to 1 million lira. The advance payment cannot exceed the investor’s net investment amount and finalized receivable.

Payments will be made from distributable cash obtained from fund assets. If the cash is insufficient, the amount will be distributed proportionally among the entitled parties. The SPK may decide that payments be made starting from the lowest net investment amount and determine the minimum advance payment amount.

INFLATION UPDATE WILL BE MADE

Past cash flows will be updated with the average of the changes in the Consumer Price Index (CPI) and Producer Price Index (PPI). Outflows from the fund, however, will be matched according to the “first in, first out” principle.

Investors who exited the fund at non-real prices before liquidation and obtained extraordinary returns may voluntarily return this gain.

SEIZED ASSETS TO INVESTORS

According to the bill, assets seized or confiscated within the scope of criminal investigations may be used to compensate investors’ losses. Assets that cannot be transferred directly to the funds will be sold by the Savings Deposit Insurance Fund (TMSF) in its capacity as trustee, and the proceeds obtained will be transferred to the relevant funds.

Fund founders, managers, portfolio management companies, or responsible persons may be held personally liable for the losses and deficiencies that arise.
