A new development has occurred regarding the Kızılbük Resort Hotel and Timeshare construction by Sinpaş GYO, which has been a topic of discussion in Turkey for years. In a statement from Kızılbük GYO, it was announced that the demolition decision for the hotel has been postponed.
Kızılbük GYO announced that the court has issued a 30-day stay order regarding the demolition decision and monetary penalty related to the Sinpaş Kızılbük Resort Hotel and Timeshare construction by the Marmaris Municipality.
The statement made by Kızılbük GYO to KAP is as follows: We have stated that our company has filed a lawsuit for the annulment of the administrative actions and the stay of execution regarding the demolition and administrative monetary penalty of 43,059.91 TL, as per the decision of the council dated 22.01.2025 and numbered 2025/177 by the Marmaris Municipality, under the case file numbered 2025/350 of the Muğla 3rd Administrative Court as of yesterday. The Muğla 3rd Administrative Court has unanimously decided today to stay the execution of the relevant council decision regarding the demolition and monetary penalty, and to set the response period for the defense and interim decision to 30 days.
Our company will continue to share all matters that need to be disclosed to the public in accordance with the principles of transparency and accountability within the framework of the regulations of the Capital Markets Board (CMB) and the legislation on Real Estate Investment Trusts.
THE MUNICIPALITY HAD INITIATED THE DEMOLITION PROCESS
The Marmaris Municipality announced on March 11 that it had published a statement regarding the demolition decision of the construction. The text stated, "Considering the possibility of a final court decision regarding the Sinpaş Kızılbük Resort Hotel and Timeshare construction, our municipality has been continuing preparations for the demolition tender for a while and has reached a conclusion. It is likely to be finalized within a week and will be put out to tender."
The statement from the municipality is as follows: Recently, many media outlets have published news titled 'Demolition Decision for Sinpaş,' which has raised questions in people's minds, and there have been reports that could lead to a misunderstanding that the Ministry of Environment and Urbanization has given a 'demolition' order to the Marmaris Municipality.
Firstly, the letter claiming that the Ministry of Environment and Urbanization has given a demolition order to the municipality regarding the Sinpaş Kızılbük Resort Hotel and Timeshare construction has not been sent by the Ministry of Environment and Urbanization. This letter was sent by the Provincial Directorate of Environment and Urbanization. Due to the region being a 'Special Environmental Protection Area' and the absence of a plan in all rural neighborhoods, the same letter is sent to the relevant institutions for every illegal structure built in this area, which has a high density of illegal construction.
"THE DEMOLITION DECISION IS NOT SPECIFIC TO OUR COMPANY"
The letter sent by the Provincial Directorate of Environment and Urbanization is not a letter specifically sent to the Sinpaş Kızılbük Resort Hotel and Timeshare construction. It is a standard letter reminding the district municipality and subsequently the metropolitan municipality of the actions and processes that must be carried out by law for all illegal structures. There are hundreds of letters with the same content in our municipality. In fact, it is not a letter written specifically for the Sinpaş Kızılbük Resort Hotel and Timeshare, but a routine letter written for all illegal structures.
However, our municipality is meticulously and seriously following the illegal construction process, just like all other illegal constructions, and will carry out the demolition work and processes within a work program after the completion of the legal processes following the final demolition decision.
On the other hand, regarding the Sinpaş Kızılbük Resort Hotel and Timeshare construction, our municipality has been continuing preparations for the demolition tender considering the possibility of a final court decision and has reached a conclusion. It is likely to be finalized within a week and will be put out to tender.
