With the regulation published in the Official Gazette, the secure payment system applied to second-hand vehicle sales is being extended to the real estate sector. Starting July 1, in real estate purchase and sale transactions, part or all of the payment will be made through a system established by banks and financial institutions. The regulation aims to ensure transactions are carried out securely and in a registered manner.
The “Regulation on Amendments to the Regulation on Real Estate Trade” prepared by the Ministry of Treasury and Finance was published in the Official Gazette. With the new regulation, significant changes have been made to real estate trade.
PAYMENTS NOW THROUGH THE SYSTEM
According to the regulation, part or all of the payment transactions in real estate purchase and sale will be carried out through the “payment system” established by banks and financial institutions. The portion of the property price not covered by credit will also be mandatory to be transferred through this system.
SERVICE FEE TO BE CHARGED
Within the scope of the regulation, a service fee will be charged for transactions made through the system. This fee will be deducted from the amount to be transferred to the seller. The aim is to ensure payments in sales transactions are made securely and in a recorded manner.
CERTIFICATE OF AUTHORITY AND NOTIFICATION OBLIGATION
With the new regulation, changes such as business address, trade name, and scope of activity must be notified within a certain period. In such changes, the certificate of authority will need to be renewed.
The procedures and principles regarding the payment system and technical processes will be determined by the Ministry of Environment, Urbanization and Climate Change.
MANDATORY AFTER JULY 1, 2026
The use of the said system will not be mandatory until July 1, 2026. After this date, the application will become mandatory. The Ministry has the authority to extend this period by up to three months.
The regulation enters into force on the date of its publication, and the Minister of Trade will implement it.
