A two-phase plan regarding the Terror-Free Turkey law

In the scope of the Terror-Free Turkey process, a two-phase formula has emerged in the legal regulation being worked on. While the framework law including regulations for non-involved organization members is planned to be presented to the Parliament in July, it is being considered that execution regulations for those who participated in armed actions will be introduced later as a separate law. Additionally, the first returns are expected to begin after the law takes effect.

As work intensifies on the planned legal regulation related to the Terror-Free Turkey process, the formula of implementing the legal regulation in two stages, rather than a single law that would also include execution arrangements, has come to the forefront. Accordingly, the framework law, which will determine the basic principles of how the process will proceed, will include arrangements for organization members who have never been involved in any crime. Execution arrangements for those who have committed crimes may be introduced as a second law. The framework law is expected to be brought to the parliamentary agenda in July.

According to the framework law being worked on, the process of fully dissolving the armed terrorist organization and its disarmament will first be monitored within the framework of objective, measurable, and verifiable criteria. In order for organization members coming to Turkey to benefit from probation, the delivery of all types of weapons and ammunition under the control of the PKK will be recorded by intelligence and security units.

INITIAL PROCEDURES FOR THOSE NOT INVOLVED IN CRIMES

According to the report by Haberler.com Ankara Representative Şerife Güzel; in the first phase, procedures will be carried out for organization members who have not been involved in crimes. If it is determined with concrete evidence that the organizational ties have been severed, a conditional execution regime will be applied by court decision.

HOW MANY ORGANIZATION MEMBERS ARE IN KANDIL?

Based on the determinations of intelligence and security units, it is estimated that there are 7,000 organization members in the Kandil region, where the organization is heavily concentrated, and around 4,000 in other camps. The group that will come to Turkey in the first phase will consist of those who joined the organization but did not participate in any armed action. It was noted that organization sympathizers who left Turkey years ago and moved to Syria and Iraq, and who established lives in those regions without joining the organization, are also waiting to return to Turkey under this scope. It is stated that this group may also be among those arriving in the first phase.

FIRST ARRIVALS MAY BE AFTER JULY

The framework law being worked on is expected to be brought to the parliamentary agenda in July. It is stated that following the passage of the law from parliament, those whose procedures will be processed in the first phase may arrive in Turkey. The framework law will include a time limit for the arrival of organization members to Turkey. It will be stated that this period can be extended in two-month intervals.

THOSE INVOLVED IN ARMED ACTIONS IN THE SECOND PHASE

The challenging phase of the legal regulation involves the legal arrangement concerning the group that carried out the organization's armed actions. Legal experts are focusing on bringing the execution regulation for those in this group as a second law. With the arrival of disarmed organization members in Turkey and the observation that the process is proceeding smoothly, an execution regulation for those involved in crimes could be brought to parliament.

WHO WILL COME TO IMRALI?

Various formulas are being considered regarding where senior organization leaders will go. While earlier, the focus was on sending around 200 individuals directly to Scandinavian countries such as Sweden and to African countries, later it came to the agenda that some of them would come to Turkey to serve their sentences on Imralı Island. However, based on recent determinations, it is stated that both methods could be applied. Some will serve their sentences on Imralı, but their number will be limited. It is expected that those approved by Öcalan will be placed on Imralı.
