"WITHOUT A GOOD EXECUTION REGIME, CRIMINAL JUSTICE CANNOT BE FULLY ACHIEVED" Yıldız, who made a statement on social media regarding the issue, said, "Without a good execution regime, criminal justice cannot be fully achieved." Emphasizing that fundamental rights and freedoms are a natural consequence of being human, Yıldız stated, "A state that establishes protective justice respectful of human rights and is subject to judicial oversight is a rule of law." Yıldız said that there should be an execution law that centers human dignity, is not complex, is simple, and ensures execution justice.
MHP Deputy Chairman Feti Yıldız "FUNDAMENTAL RIGHTS AND FREEDOMS ARE A NATURAL CONSEQUENCE OF BEING HUMAN" In his statement, Yıldız included the following remarks: "There is a significant consensus in society regarding a new execution law, similar to a new constitution. Without a good execution regime, no matter how good the Criminal Code and Criminal Procedure Code are, criminal justice cannot be fully achieved. In every part of the world, the state's right to punish conflicts with the rights of the accused. In a rule of law, the boundaries of this conflict are drawn by laws, the constitution, and human rights treaties. Every person has fundamental rights and freedoms that are inviolable, inalienable, and indispensable, depending on their personality. Fundamental rights and freedoms are a natural consequence of being human. They do not arise from a contract nor are they a favor.
"STATE ORGANS AND ADMINISTRATIVE AUTHORITIES MUST ACT IN ACCORDANCE WITH THE PRINCIPLE OF EQUALITY BEFORE THE LAW IN ALL THEIR PROCEEDINGS" State organs and administrative authorities must act in accordance with the principle of equality before the law in all their proceedings. The purpose of the principle of equality defined in our constitution is to ensure that persons with the same legal status are subjected to the same procedures before the law. A state that establishes protective justice respectful of human rights and is subject to judicial oversight is a rule of law.
"THE GRAND NATIONAL ASSEMBLY OF TURKEY MUST PRIORITIZE AN EXECUTION LAW THAT CENTERS HUMAN DIGNITY" The Grand National Assembly of Turkey must prioritize an execution law that centers human dignity, is understandable to convicts as well as practitioners such as judges, prosecutors, and lawyers, is not complex, is simple, considers the rehabilitative functions of punishment, ensures equality and justice in execution, does not create a perception of impunity, and will not need frequent amendments. Furthermore, a new constitution will shape Turkey's future alongside a legal reform. We can no longer delay achieving a strong new constitutional framework that will protect Turkey's national identity, geographical integrity, and political unity in every aspect.
