The details of the 'framework law' bill expected to be presented to Parliament today have emerged. The 'Law Proposal on Strengthening National Solidarity and Social Integration,' consisting of 12 articles, excludes serious crimes such as homicide and sexual assault, and also keeps convicts sentenced to aggravated life imprisonment and life imprisonment before 2005 outside the law. Additionally, members of organizations will be required to apply within 6 months from the law's entry into force.
The content of the "Law Proposal on Strengthening National Solidarity and Social Integration" within the scope of the Türkiye without Terrorism process has been revealed. The implementation of the regulation is tied to the condition that the National Security Council determines that the PKK/KCK-affiliated structures have been dissolved and that weapons have been completely abandoned. Once this condition is met, the proposal includes the postponement of investigations, prosecutions, and finalized sentences for certain crimes.
WILL ÖCALAN BENEFIT?
Whether the leader of the terrorist organization PKK, Abdullah Öcalan, would benefit from the regulation in the prepared proposal was a topic of debate on the agenda.
According to the proposal, those who received aggravated life imprisonment sentences before 2005 and those tried for crimes requiring this sentence are excluded from the scope. Thus, it is seen that Öcalan's benefiting from the law is prevented.
The details of the law text, which will consist of 12 articles, are as follows;
- One of the most notable regulations in the proposal will be the scope article. Instead of general expressions like "organization that abandons weapons and dissolves itself," the phrase "PKK, KCK, and organizations associated with affiliated structures" is clearly included in the scope of the law.
- The proposal does not foresee an amnesty for organization members, but it opens the way for the postponement of sentences and the dismissal of organization-related crimes.
- Those who received aggravated life imprisonment before 2005 or those who committed crimes requiring aggravated life imprisonment will be excluded from the scope of the law. This prevents PKK leader Abdullah Öcalan from benefiting from the law.
- Within the scope of organization crimes, a five-year postponement of sentences is foreseen for crimes under 15 years, and a ten-year postponement for crimes over 15 years. At the end of these periods, if the necessary conditions are met, the sentence is foreseen to be dropped.
POLITICAL PATH OPENED FOR THOSE NOT INVOLVED IN CRIMES FOR 3 YEARS
- Within the scope of members of these organizations; those who wish to benefit from the temporary regulation will need to apply within 6 months from the entry into force of the law. At the end of this period, the right to apply will expire.
- The regulation; rather than being for organization members in Europe, the mountain cadre, or those in prison; it will benefit those under investigation, those with ongoing prosecutions, convicts, and those who voluntarily apply to the state.
- The "Evaluation and Coordination Committee," to be established under the chairmanship of the Vice President for confirmation and determination, will consist of eight members. The Committee will include the Vice President, the Secretary General of the Presidency, the Head of the National Intelligence Organization (MİT), and the Ministers of Justice, Interior, Family and Social Services, National Defense, and Labor.
- With the law, a Monitoring Committee will also be established within the Turkish Grand National Assembly (TBMM). The Speaker of the TBMM will decide who will be on the committee. The commission established by law will not be subject to the provisions of the Parliamentary Rules of Procedure.
- The opening of a new terrorism investigation against those who benefit from the law is also left to the decision of the committee.
