In Ankara, 10-year-old Mehmet Ulaş C. fell while walking on a bollard in the supermarket parking lot and injured his leg. Following the father's criminal complaint, the expert report found the business not at fault and held the father primarily at fault for failing to give the necessary warning. While the prosecutor's office issued a decision not to prosecute, the family objected to the decision and filed a compensation lawsuit against the supermarket.
Mehmet Ulaş C., 10, in ANKARA was walking on a parking stop fixed to the ground for orderly and safe parking in a market parking lot when he lost his balance, fell, and injured his leg. Father Kerim C. alleged that his son was injured because the connection nut of the parking stop was protruding, and in the criminal complaint he filed, the prosecutor's office issued a decision not to prosecute.
HE FELL IN THE PARKING LOT AND INJURED HIS LEG
After leaving the market with his father Kerim C., Mehmet Ulaş C. lost his balance and fell while walking over the parking stop in the parking lot. Mehmet Ulaş C., who was injured in his leg, was discharged after treatment at the hospital. Kerim C. alleged that the protruding connection nut of the parking stop was effective in the accident that caused his son's leg injury and filed a criminal complaint with the Ankara Chief Public Prosecutor's Office.
THE EXPERT FOUND THE FATHER PRIMARILY AT FAULT
In the expert report prepared as part of the prosecutor's investigation, it was stated that the business had no fault in the occurrence of the accident, while the father was found primarily at fault for failing to exercise the necessary care and give warnings regarding elements such as the parking stop that should not be walked on. The prosecutor's office decided that there were no grounds for prosecution in line with the report. Father Kerim C. objected to the decision and filed a compensation lawsuit against the market.
WE OBJECTED TO THE DECISION
The family's lawyer, Handan Sayan Özgül, said that the family filed a criminal complaint thinking that the business was negligent, and stated: "The market appears faultless in the single expert report prepared, and no criminal case is filed against them. When we examined the file, we identified certain points, especially in the expert report, and submitted our objections within the framework of the points we identified. Here, another expert report should have been obtained and the measures the business could take and the assessments it could make should have been considered. We have also filed our compensation lawsuit in this regard. We will follow the process."
