FOREIGN TOOTHBRUSH TRIGGERED SUSPICIONS
The couple, who married in 2021, lived with the man's family and occasionally stayed at their vacation home. In September 2023, the man found a used toothbrush that did not belong to him in this house.
Suspecting something, the man examined the security camera footage of the house's parking lot. In the footage, he saw an unfamiliar man dropping his wife off at the house and spending the night there.
HE REMOTELY OPERATED THE ROBOT VACUUM
About three months later, the man remotely operated the robot vacuum cleaner at home via a mobile application. His initial goal was to use the device's voice communication feature to talk to his wife.
However, when he connected to the robot's live camera feed, he saw his wife with another man. He then began recording the images. It was reported that the recordings included moments where the woman was intimate with the other man, changed clothes, and was naked.
WON 500,000 TAIWANESE DOLLARS IN DAMAGES
The man used the footage he obtained as evidence and filed a lawsuit against his wife and the other man. In his case, where he demanded 2 million Taiwanese dollars in damages, the court ruled that the relationship between the two exceeded the boundaries of ordinary friendship.
The court ordered his wife and the other man to pay the man a total of 500,000 Taiwanese dollars in damages. This amount is equivalent to approximately 16,000 US dollars.
THIS TIME, HIS WIFE FILED A COUNTERCLAIM
However, the man's victory in the lawsuit was not the end of the story. His wife filed a complaint against her husband, stating that her private images were recorded without her consent.
The man argued that he recorded the images to prove his wife's infidelity and protect his marital rights. He also said that the images had been accepted as evidence in the previous civil case.
COURT: MARRIAGE DOES NOT ELIMINATE THE RIGHT TO PRIVACY
The Taoyuan District Court did not accept the man's defense. The court ruled that being married does not allow a person to indefinitely monitor their spouse's private life.
The judges considered that the woman had a reasonable expectation of privacy within the home, and this right was even more pronounced, especially when she was naked.
The court also noted that the images were not recorded accidentally. It was stated that the man consciously activated the recording feature after seeing the other man on the robot vacuum's live feed.
WON DAMAGES BUT WENT TO JAIL
Ultimately, the man was sentenced to 5 months in prison for illegally recording another person's private and intimate images. Additionally, he was fined 150,000 Taiwanese dollars. It was also stated that the prison sentence could be converted into a fine. The ruling was reported to be subject to appeal.
