In Antalya, Ali Süslü, who was sent to prison because of another person with the same name's finalized prison sentence, served a punishment for a crime he did not commit for exactly 10 days. While the truth came to light during a record review conducted in the prison, Süslü initiated a legal struggle after the injustice he experienced.
Ali Süslü, a real estate agent in Antalya, was sent to prison because there was a finalized prison sentence against him. However, an examination 9 days later revealed that the sentence belonged to another person with the same name. Despite having different national ID numbers and addresses, Süslü was kept in prison and was released after completing his 10-day sentence.
HE WAS CALLED TO THE POLICE STATION WITH 'YOU HAVE A SIGNATURE'
Ali Süslü's life, who works in real estate in Konyaaltı district, changed with a phone call from the police station on July 26. Süslü, who was called by the police saying, 'You have a signature, you need to come to the police station,' went to the station despite having had surgery shortly before.
Süslü, who was detained there, claimed that when he asked why he was being detained, he was not given a clear answer. Then, Süslü, who was referred to the courthouse, learned that he would be sent to prison while he thought he would meet with the prosecutor.
HE WENT TO PRISON WITHOUT KNOWING HIS CRIME
The next day, Süslü was sent to Antalya L-Type Closed Penal Institution because there was a finalized 10-day prison sentence against him.
Süslü, who was trying to understand why he was in prison, repeatedly stated that the crime attributed to him was not his. However, according to his claim, his warnings were not taken into account.
Süslü, who also had health problems in prison because he had undergone surgery, was referred to the hospital twice.
THE ERROR WAS NOTICED ON THE 9TH DAY
The mistake came to light on the 9th day of his stay in prison.
After Süslü explained his situation to the prison psychologist during a routine meeting, the records were re-examined. The check revealed that the sentence belonged to another person named Ali Süslü.
It was determined that the person with the same name was another individual, a 23-year-old living in Adana, and that the national ID numbers and residential addresses of the two people were different from each other.
It was reported that at this stage, Süslü was told that a mistake had been made and an apology was offered to him.
"IF IT'S NOT ME, WHY AM I SERVING A SENTENCE?"
Süslü, who reacted to his situation, stated that after the explanation given to him, he expected to be released from prison immediately, but this time he was told he had to complete his 10-day sentence.
Süslü described the contradiction he experienced with these words:
"If it's not me, how can I have a finalized sentence? How are you holding me?"
Süslü said he was released under hospital supervision after the 10-day period ended.
"THE MOVIE 'PARDON' BECAME REAL"
Süslü, who stated that his life was seriously affected after getting out of prison, noted that various rumors were spread about him and his business relations deteriorated.
Süslü, who said that gossip spread that he had defrauded people, stated that his contracts were broken, he suffered financial losses, and he became unemployed.
Süslü, who compared what he experienced to the movie "Pardon" (Sorry), directed by Mert Baykal and starring Ferhan Şensoy, Rasim Öztekin, and Bülent Kayabaş, said, "I guess the movie 'Pardon' became real. It happened to me too."
HIS LAWYER FILED A CRIMINAL COMPLAINT
Due to what happened, Süslü filed a criminal complaint against the relevant officials through his lawyer, Abdullah İlkkahraman.
Lawyer İlkkahraman stated that his client was sent to prison due to a case of mistaken identity and that the situation was only understood on the 9th day through a record review.
İlkkahraman said that his client was held in prison even though he had undergone surgery, experienced health problems there, and was taken to the emergency room twice.
Stating that a legal process has been initiated within the scope of the crimes of "misuse of office", "negligence of duty", and "deprivation of liberty" following the events, İlkkahraman stated that they would fight to compensate for the material and moral damages suffered by his client.
İlkkahraman, who argued that the movie "Pardon" was experienced in real life, noted that they would continue their legal fight to prevent a similar victimization from happening again.
