In the dispute over moral compensation and alimony between businessman Besim Tibuk and his wife Serap Tibuk, the Court of Cassation ruled to overturn the decision, finding the appellate court's compensation amount of 50 million Turkish lira to be insufficient.

500 MILLION IN MATERIAL DAMAGES, 1 BILLION LIRA IN MORAL COMPENSATION REQUESTED



Serap Tibuk filed for divorce, claiming that she was subjected to economic violence. Tibuk demanded 2 billion 500 million lira in material damages and 1 billion lira in moral compensation from her husband.



THE COURT FOUND 50 MILLION IN COMPENSATION TO BE INSUFFICIENT



The Istanbul 14th Family Court ruled that Besim Tibuk was at fault in the events leading to the divorce, ordering him to pay Serap Tibuk 750 million lira in material damages, 500 thousand lira in alimony, and 100 million lira in moral compensation. In the appeal case brought to the higher court, the Istanbul Regional Court of Appeal reduced the alimony to 350 thousand lira, finding it excessive. The court also reduced the compensation from 750 million lira to 50 million lira and rejected the moral compensation request. The Court of Cassation found the 50 million lira compensation amount to be insufficient and ruled for the annulment of the decision.



The decision made by the 2nd Civil Chamber of the Court of Cassation included the following statements:



"Considering the identified economic and social conditions and the degrees of fault in the events leading to the divorce, the material compensation determined in favor of the woman is insufficient. A more appropriate amount of compensation should be determined. For the reasons stated, it was decided to annul the regional court's decision regarding the amount of material compensation in favor of the woman."
