In the case concerning Said Bey Site, which collapsed in the February 6, 2023 earthquakes in Kahramanmaraş and where 44 people died, 8 of the 11 defendants, 2 of whom are public officials, were sentenced to prison. The detained defendant was given 11 years, 1 month and 10 days; five defendants were given 8 years, 10 months and 20 days each; two public officials were given 5 years each.
In the case concerning the deaths of 44 people at Said Bey Sitesi, which collapsed in the February 6, 2023 earthquakes in Kahramanmaraş, 8 of 11 defendants, 2 of whom are public officials, were sentenced to imprisonment.
DECISION IN THE SAID BEY SITESI CASE
The hearing at the Kahramanmaraş 4th Heavy Penal Court was attended by detained defendant Hasan Çam, the complainants, and the parties' lawyers. Defendants Y.K. and M.Y., who are not in detention, joined the hearing via the Audio and Visual Information System (SEGBİS) from the provinces where they are located. The other defendants not in detention were not present at the hearing.
Detained defendant Hasan Çam, who was asked for his final statement by the court panel, repeated his previous defense and requested acquittal.
Çam, arguing that he had no technical knowledge of construction, said: "I do not accept the accusations attributed to me. I only had the building constructed by paying its price. I do not understand technical matters. The building was constructed in accordance with its project."
The other defendants not in detention also rejected the accusations and sought acquittal. The defendants' lawyers also requested acquittal, arguing that their clients were innocent.
The complainants, who were given the floor at the hearing, requested that the defendants be punished in the most severe manner.
The prosecutor at the hearing requested that the defendants be punished for the offense of "causing the death and injury of more than one person by conscious negligence."
The court panel recessed the hearing to announce its decision.
SENTENCES GIVEN TO THE DEFENDANTS
After the recess, the court panel announced its decision and sentenced detained defendant Hasan Çam to 11 years, 1 month, and 10 days in prison for the offense of "causing the death and injury of more than one person by conscious negligence."
Defendants H.Y., Y.K., M.Y., H.İ.U., and M.K., who were not in detention, were sentenced to 8 years, 10 months, and 20 days in prison each for the same offense. The defendants were also banned from practicing their profession for 2 years.
The public officials tried without detention, A.Ö., former Acting Director of Zoning and Urbanization at Dulkadiroğlu Municipality, and S.B., who served as an architect at the municipality, were each sentenced to 5 years in prison for the offense of "causing the death and injury of more than one person by negligence."
The court panel decided to separate the case files of İ.K., the static project and implementation supervisor, and Z.B.K. and S.A., officials of the construction inspection company.
In the indictment prepared by the Kahramanmaraş Chief Public Prosecutor's Office, a case had been filed against the defendants regarding Said Bey Sitesi, which collapsed in the February 6, 2023 earthquakes and where 44 people lost their lives, for the offense of "causing the death and injury of more than one person by conscious negligence."
