The regulation on Compulsory Earthquake Insurance (DASK), which closely concerns millions of homeowners and citizens who will buy or sell real estate, has been published in the Official Gazette. With the new amendment made by the Insurance and Private Pension Regulation and Supervision Agency (SEDDK), the practice of transferring the DASK policy of the former property owner to the new owner in housing sales has officially come to an end.
With the regulation published in the Official Gazette, the DASK system has changed in housing sales.
POLICY TRANSFER APPLICATION REMOVED IN SALES
With the update made to the article titled "Change of Interest Holder" of the General Conditions for Mandatory Earthquake Insurance, the insurance process in real estate purchase and sale transactions has been completely reshaped. Until now, when a house was sold, the existing DASK policy belonging to the seller could be directly transferred to the new property owner. However, with the published communiqué, this transfer process has been abolished. According to the new period, if the property changes hands through sale, the existing DASK contract will automatically terminate as of the registration date at the land registry.
UNUSED PREMIUMS WILL BE REFUNDED
The most important detail of the regulation that will please those selling real estate is the fate of the paid premiums. After the contract terminates with the title deed transfer, the paid premium amounts for the unused days of the policy will be refunded to the old insurance holder who sold the house. On the other hand, land registry directorates or other authorities authorized to carry out the sale will check whether the new property owner has taken out a new Mandatory Earthquake Insurance from scratch in their own name during the transfer procedures.
15-DAY CONDITION FOR INHERITED HOUSES
The communiqué also contains special conditions for properties that change hands through inheritance, as well as house sales. If the property changes hands through means other than sale, such as inheritance, the existing DASK contract will not be canceled and the policy will continue with the new rights holder. However, the new owner of the dwelling will be required to notify the insurance company of the situation within at most 15 days from the date they learn of the ownership change and the existence of the insurance contract. The relevant insurance company or agency, upon receiving this notification, will be obliged to complete the necessary endorsement (amendment document) procedures within 24 hours and deliver the updated policy to the new owner. The said regulation will officially enter into force 15 days after its publication date in the Official Gazette.
