In Kocaeli's Izmit district, the testimonies of Mert P., who is on trial for allegedly killing his brother by cutting his throat, and his mother were chilling. The defendant, who stated that his brother had sexually abused him since he was 13 years old and said, "He was using me like his wife," was sentenced to 15 years in prison for "intentional murder," with reductions for provocation and good behavior.
On March 27, an argument broke out between 34-year-old Mert P. and his 45-year-old brother Murat P. for an unknown reason in their apartment on Tunalı Street in Erenler Neighborhood. As the argument escalated into a fight, Murat P.'s throat was cut with a knife. Upon notification, police and medical teams were dispatched to the address. The medical teams, who arrived at the scene shortly, took the injured person to the hospital by ambulance. Despite all interventions at the hospital, Murat P. could not be saved and died. Police teams detained Mert P. and their mother, Hatice P., who was present at the time of the incident. Mert P., who was detained, was arrested by the court after his statement and sent to prison. Mother P. was released.
The trial of the detained defendant Mert P. began at the Kocaeli 4th High Criminal Court. The hearing was attended by the detained defendant Mert P., his lawyer, and mother Hatice P. Mert P. recounted that on the day of the incident, his mother had gone to work, and he stayed home with his brother. "My brother later left the house, and I was left alone. In the evening, first my mother, then my brother Murat came home. My brother and I went to the market to get household supplies. After shopping, Murat bought 2 beers and 2 wines. After returning home, I started cooking. My brother started gambling on betting sites. I took the food to my mother. She ate her meal while I was washing the dishes in the kitchen," he said.
While washing the dishes, Mert P. stated that his brother Murat P. came to him and asked for money. "I told him I didn't have any money. After that, Murat went to my mother. Later, he went to the room to drink wine. After a while, he came back with a knife and harassed me from behind. I tried to stop him. He tried to attack me. I held his wrist that had the knife. At that moment, as Murat quickly pulled his hand towards himself, the knife came to his throat, and he was injured. My mother witnessed what happened. I went to my mother because I was scared, and we moved to the room together. My brother followed us, then returned to the kitchen and fell there," he explained.
"HE WAS DRESSING ME IN MY MOTHER'S UNDERWEAR AND ATTACKING ME"
Mert P. stated that his brother lost consciousness, and he intervened and reported to the 112 Emergency Call Center. He also mentioned that his brother Murat P. had sexually abused him since he was 13 years old, saying, "On the day of the incident, he also wanted to sexually harass me. He threatened to kill my mother. I saved my mother from him several times. He threatened to kill my mother and my brother M's wife if I talked about the rape incidents. I even kept watch in front of my mother's door to prevent him from harming her. Murat constantly dressed me in my mother's underwear and sexually assaulted me that way," he stated.
Mert P. continued his defense: "As I learned in the prosecution, Murat had also sexually harassed my brother M. Murat used to beat my mother a lot and tried to choke her. He would hit my mother with the handle of the vacuum cleaner and rub her head against the wall. I love my mother very much. I never let her do any work at home; I always did it. I never complained about what my brother Murat did to me. I only told my mother about the harassment my brother did to me two months before the incident. Other than that, no one knew what he did to me. When Murat sexually assaulted me, he would cover my mouth. My mother sometimes heard the noises but couldn't come to us because she was scared. A week before the incident, he sexually assaulted me again.
"I WAS SCARED BECAUSE I THOUGHT HE WAS NOT DEAD, I GAVE A FALSE STATEMENT"
Admitting that he told some things differently in his first statement, Mert P. said, "In the prosecution, I told some things differently because I didn't know my brother was dead yet. Although I said I was raped at 18, I was actually raped at 13. Also, the issue of the knife being in my hand is also incorrect; the knife was in my brother's hand. He was very drunk on the day of the incident. During the investigation, I couldn't explain some issues because I didn't know my brother had killed him and I was scared. My brother separated me from my girlfriend because he was using me like his wife. My brother Murat would always come at me with a knife. On the day of the incident, he attacked me with a knife. He pulled down my clothes, and I pushed him away with my hand. At that moment, he swung the knife at me, I grabbed his wrist, and as he quickly pulled his hand towards himself, the knife came to his throat," he said. After the defendant's defense, the mother H. P. was also given the right to speak. Mother H. P. explained that her son Murat made her work, saying, "He would make me sell tissues, and he would take that money from me. That day, I came home around 5:00 PM from work. My son Mert was at home, and Murat had not yet arrived. Murat came home about an hour later. Then my two sons went shopping and returned. Mert started cooking. When Mert finished cooking, he brought it to me. I ate my meal, while Murat was drinking wine and gambling. I saw that Murat put a pill in the wine he had. After a while, I went to my room because I felt sleepy and fell asleep," she said.
After a while, mother H. P. stated that Murat came into the room with a knife, saying, "Murat asked me for money for gambling. I told him I didn't have any money. After that, he slammed the door and left. After a while, I heard Mert shouting, 'Brother, don't do it, let go, calm down.' I went to the place where the sounds were because Murat might have been about to rape Mert. Murat had a knife in his hand. Mert held Murat's hand. When Murat quickly pulled his hand, the knife came to Mert's throat. Mert applied pressure to his wound. I am not complaining about my son Mert. My son Murat has done everything to us," she stated.
"I KNEW BY THE SOUNDS I HEARD, BUT I COULDN'T COMPLAIN OUT OF FEAR"
Mother H. P. stated that her son Murat also attempted to sexually assault her.
```"Murat was scared when he said to him, 'I will disgrace you in the neighborhood.' I wanted to report it, but I was afraid because he threatened us with death. The victim used to beat me and Mert. He even beat Mert with a metal object found in the house. I couldn't protect my son Mert. Even though I didn't see it with my own eyes, I heard sounds that indicated Murat was sexually harassing Mert, but we couldn't report it out of fear. If we reported it, he would come back in the same way and kill us. Murat would sometimes say that he wanted to commit suicide and go to his father's side. He always carried a knife," he said. The defendant's middle brother, M. P., stated that he had no eyewitness account of the night of the incident, saying, "When I was 14 years old, my brother Murat sexually abused me. My mother worked as a dishwasher in a restaurant. We were alone at home with my three siblings. My brother would look at pornographic magazines. He would say to me, 'Come, let's do it like this.' I didn't understand because I was too young. When I was little, Murat made me wear my mother's skirt and started to caress me from behind. When it hurt, I ran away and cried. When I said I would tell my mother, he didn't do anything. He attempted the same thing a few more times, but when I reacted, he stopped. He was scared when I said, 'I will tell my mother.' Since I resisted, he gave up on me and turned to my brother. My brother was 5 years old at that time," he said. "HE CRIED SAYING, 'I COULDN'T TAKE CARE OF OUR FATHER'S LEGACY'"M. P. expressed that he thought the events were a game because he was young, saying, "I didn't think of anything bad. I never thought my brother could do such a thing to my brother. We would sometimes witness their arguments, but I did not witness the sexual assault incident. The victim was violent towards me and my family members. Last year, he threw me out of the house. The victim called me before, he was drunk and crying. He always referred to my brother Mert as 'our father's legacy.' He cried, saying, 'I couldn't take care of our father's legacy,' and I thought he was sad because he couldn't get him a job. I couldn't think about the harassment incident," he said. The defendant was sentenced to 15 years in prison for the crime of intentional murder, with provocation and good behavior reductions applied.
