In the İçmeler neighborhood of Marmaris district in Muğla, regarding the construction of Sinpaş Kızılbük Resort Hotel and Timeshare, which began its first construction works in 1987 during the late 8th President Turgut Özal's term, Marmaris Mayor Acar Ünlü stated, "Recently, many media outlets have published news titled 'Demolition decision for Sinpaş,' which has raised questions in people's minds, and there have been reports that could lead to a misunderstanding that the Ministry of Environment and Urbanization has given a 'demolition' order to Marmaris Municipality."
"THE SAME LETTER IS SENT FOR EVERY ILLEGAL STRUCTURE"
"Firstly, the letter claiming that the Ministry of Environment and Urbanization has given a demolition order to the municipality regarding the Sinpaş Kızılbük Resort Hotel and Timeshare construction has not been sent by the Ministry of Environment and Urbanization. This letter has been sent by the Provincial Directorate of Environment and Urbanization. Due to the region being a 'Special Environmental Protection Area' and the lack of a plan in all rural neighborhoods, the same letter is sent to the relevant institutions for every illegal structure built in this area where illegal construction is intense," he said.
"SINPAŞ KIZILBÜK HOTEL WILL BE DEMOLISHED AFTER LEGAL PROCEEDINGS"
Stating that the letter sent by the Provincial Directorate of Environment and Urbanization is not a letter specifically sent for the Hotel and Timeshare construction, Mayor Ünlü said, "It is a standard letter reminding the district municipality and then the metropolitan municipality of the legal obligations they must fulfill for all illegal structures. Our municipality has hundreds of letters with the same content. In fact, it is not a letter written specifically for Sinpaş Kızılbük Resort Hotel and Timeshare, but a routine letter written for all illegal structures. However, our municipality is meticulously and seriously following the illegal construction process, just like in all other illegal constructions, and will carry out the demolition work and processes within a work program after the completion of the legal processes and the final demolition decision. On the other hand, regarding the Sinpaş Kızılbük Resort Hotel and Timeshare construction, preparations for the demolition tender have been ongoing for a while, considering the possibility of a final court decision, and it has reached a conclusion. It is likely to be finalized within a week and will be put out to tender. We inform you," he stated.
SINPAŞ HAD STATED, "DEMOLITION IS NOT LEGAL"
Recently, regarding the Sinpaş Kızılbük Resort Hotel and Timeshare, which has become a topic of discussion again, Sinpaş made a statement to the Public Disclosure Platform. The statement included the following: "The administrative and judicial processes regarding the project our company is carrying out in Marmaris are ongoing, and there is no finalized court decision regarding the projects our company is conducting. It is also legally impossible for Marmaris Municipality to act contrary to its previous decisions due to the principle of administrative stability, to make irreversible decisions while the litigation is ongoing, and to implement them."
"WE HAVE NOT ENGAGED IN ANY ACTIVITIES CONTRARY TO BUILDING PERMITS"
As we have previously stated to the public multiple times, our company has not engaged in any activities contrary to the zoning plan, zoning status, and building permits issued by the municipality within the scope of the project. The first phase of the project, consisting of a hotel and timeshare, has been constructed according to the building permits issued by Marmaris Municipality, and since the structure was completed in accordance with the permit, a occupancy permit has also been issued. It is also legally impossible to demolish a structure for which an occupancy permit has been obtained or to make a decision regarding its demolition. It is indisputable that established Council of State decisions grant acquired rights to the owner of a structure for which an occupancy permit has been obtained. Furthermore, the construction of the second phase of the project has also been largely completed and has exceeded the level that grants acquired rights. To date, no council decision regarding the demolition of the mentioned structures has been communicated to our company by Marmaris Municipality. There is also no information or document indicating that there is any official instruction or letter regarding the demolition of these structures. In fact, Marmaris Municipality has also shared with the public that there is no finalized court decision regarding the demolition and that they are waiting for the outcome of the litigation. Setting aside the existence of a finalized decision, there is not even a decision regarding demolition.
