Narin's brother called from prison and gave the instruction: Don't talk to anyone.

In the indictment prepared as part of the investigation into the murder of Narin Güran in Diyarbakır, it was stated that the brother Enes Güran, who is facing aggravated life imprisonment, called his brother from prison and said, "Don't talk to anyone. Take care of yourself." The indictment also included that Enes Güran asked his brother over the phone, "Did the report come? Narin had used my toothbrush, will anything come out?"

AGGRAVATED LIFE IMPRISONMENT REQUEST FOR 4 PEOPLE IN THE NARIN MURDER CASE

An indictment was prepared regarding the murder of Narin Güran, who went missing in the Tavşantepe neighborhood of the Bağlar district of Diyarbakır on August 21 and was found dead in the bed of the Eğertutmaz stream on September 8. In the indictment submitted to the Diyarbakır 8th High Criminal Court by the Diyarbakır Chief Public Prosecutor's Office, it was requested that the detained suspects, uncle Salim Güran, mother Yüksel Güran, brother Enes Güran, and neighbor Nevzat Bahtiyar, be sentenced to aggravated life imprisonment for the crime of "intentional murder of a child in participation."

NARIN'S BROTHER: DON'T TALK TO ANYONE, TAKE CARE OF YOURSELF

The indictment also included interesting details. It was stated that the recorded conversations of brother Enes Güran, who is detained in the Diyarbakır Type T Closed Prison No. 1, were examined, and the following information was shared: "In the examination and review conducted by our Chief Public Prosecutor's Office regarding numerous phone calls and the records of closed visits, it was determined that on September 17, during a phone conversation between Enes and his younger brother, he stated, 'Don't talk to anyone, take care of yourself,' and in a conversation with his brother Baran Güran, he asked several times regarding the forensic report, 'Did the report come?' and in one of the conversations, he asked his brother, 'Narin had used my toothbrush, will anything come out?'

LAW ENFORCEMENT OFFICERS WERE MISDIRECTED

It was noted in the indictment that following the family's report at 20:43 on August 21, the investigation into the missing child began, and as the investigation deepened, it was determined that the family misled law enforcement officers at various stages and made contradictory statements.

"There is no explanation for a family reporting to law enforcement at 20:43 that their daughter, who was last seen at 15:11 on the day of the incident, is missing, and it is clearly against the ordinary course of life that Narin's father, Arif Güran, who was also under investigation, learned that his daughter was missing from a friend from a neighboring village, without any family member, including his wife and children, informing him. At the beginning of the search activities, law enforcement officers were clearly misled regarding the time Narin was last seen, and in the stages of the case, it was established that Narin's lifeless body was left in the Eğertutmaz stream around 16:00. The statements of Maşallah, Birsen, and Melike Güran, who claimed to have seen her at 17:40, and the statement of a child named M.K. at 18:47 regarding seeing Narin indicate that the family acted in an organized manner, attempting to prevent the discovery of Narin and the clarification of the incident by ensuring that even child witnesses made such statements. It has been clearly established that some family members were quietly listening to the gendarmerie personnel to learn about the actions to be taken, some family members caused electric wires to touch each other to start a fire, and some attempted to mislead law enforcement personnel with a slipper they found, despite being inconsistent with their shoe size, and these matters have been recorded in the minutes. The determination that almost all family members deleted conversation, message contents, and WhatsApp records related to the day of the incident clearly indicates that the family was aware of the incident from the beginning and was engaged in intense efforts to prevent its emergence."

SALIM GÜRAN HAS MADE CONTRADICTORY STATEMENTS FROM THE BEGINNING

In the indictment, it was stated that Salim Güran made contradictory statements regarding the time Narin went missing from the very beginning in the voice recordings on his phone, and it was understood that the primary aim of the suspect was to prevent the discovery of Narin and the clear emergence of her death.

The indictment included the following information: "In the voice recording contents of Salim Güran, while informing the gendarmerie personnel, he made statements about seeing an old red car by gypsies in the village and facilitated a search in the houses of relatives of Nevzat Bahtiyar in Çarıklı neighborhood, indicating that from the first day, he was involved in an organization to hold only Nevzat Bahtiyar responsible in case of a possible negative situation, as the vehicle that Nevzat Bahtiyar left the body in was an old model red car, which clearly reveals this matter. It was also noted that the suspect could not explain the deletion of recordings he deemed important on the day of the incident from the recording program on his device and the deletion of WhatsApp records. In his last defense, his statement about meeting with sex workers was considered a defense developed against the act of deleting records, and to confirm this, he sent a message to a person considered to be a sex worker after the burial of Narin's lifeless body on the day of the incident, and the fact that this message was found on the phone without being deleted strongly supports this situation. Although he claimed not to have met with Nevzat except at 15:08 on the day of the incident, the HTS analysis and the expert report conducted in a limited area clearly showed that they were together and acted together around the time of the incident.

In the examination of the suspect's phone by an expert, it was determined that there were voice calls with Nevzat at 17:46 on the day of the incident in the deleted WhatsApp voice call records. In the investigations of Salim Güran's vehicle, it was clearly established that the DNA profiles obtained from the DNA profile found in a scraping form on the driver's seat and the hair sample from the inner part of the right rear door belonged to Narin. It was not possible to defend the situation solely by stating that the vehicle's doors were open or that all the children could have gotten into the car. Because while examining the DNA profile, a study was conducted on all possible DNA profiles that could be present in the vehicle, and only an examination was conducted on the identified DNA profile belonging to Narin. The only DNA profile obtained from the vehicle belonged to Narin, and no DNA profile related to the suspect's own family was found. In the examination conducted in the vehicle belonging to Narin's father, Arif Güran, no DNA was found either. The fact that Narin's DNA profile, which had no DNA findings even in his father's vehicle, was found in both sections of the suspect's vehicle is clearly contrary to the ordinary course of life. Technically, DNA profiles can be found in biological samples such as blood, semen, tissue, organs, hair, urine, saliva, and body fluids. The statement taken from Nevzat Bahtiyar, indicating that liquid came from Narin's mouth while he was lying on the ground, also strongly suggests that the DNA profile could have been obtained from a biological sample and that it was likely transferred to the vehicle as a result of contact with the suspect Salim. For these reasons, it has been understood that the suspect was involved in the act of murder and attempted to destroy evidence, and thus there is sufficient suspicion that he was in a joint intent regarding Narin's murder along with the other suspects.

BROTHER ENES GÜRAN MADE CONTRADICTORY STATEMENTS REGARDING THE TIME NARIN WENT MISSING

In the indictment, it was stated that brother Enes Güran consistently made contradictory statements regarding the time Narin went missing in both of his statements taken on and after the day of the incident.

In the indictment, it was stated: "It has been clearly determined that his statement about going to the neighborhood grocery store on the day of the incident is contrary to the truth, as the neighborhood grocery store was closed that day. It has been established by the HTS analysis report and the expert report that Narin was at home before and after the time he entered the last camera angle, which was 15:11. Regarding the bruises on the suspect's eyes, he initially stated that they occurred in the cornfield, but later contradicted himself by saying that he might have been hit by someone in anger. While he could not provide an explanation for the marks resembling nail scratches on his back in his initial statements, he later made contradictory statements that his back might have been scratched while entering some places during the search efforts. Due to his constant inquiries about whether the forensic reports had been released while he was in the penal institution, he has shown a concealed concern about whether any DNA belonging to him would be found on Narin's body. Considering his mention of using Narin's toothbrush and instructing his brother Eren not to tell anyone anything, it is evident that the suspect has been making contradictory statements and exhibiting behaviors from the very beginning of the incident, clearly acting out of fear of being involved in the act, and thus there is sufficient suspicion that he was in a joint intent regarding Narin's murder along with the other suspects. Suspect mother Yüksel Güran also exhibited behaviors from the early hours of the incident indicating that she knew Narin had died, expressing words that contained both sadness and fear, such as 'How can I save Enes?' The statements of Narin's sister Yasemin during the argument on the day Narin's lifeless body was found, saying 'If you had told the truth, this wouldn't have happened,' and the consistent statements in the defenses taken from Nevzat Bahtiyar suggesting a possible relationship between Yüksel and Salim Güran, as well as the statements indicating that Narin's lifeless body was taken by the suspect named Nevzat while looking back and crying, have been taken into account, leading to the conclusion that there is sufficient suspicion that he was in a joint intent regarding Narin's murder along with the other suspects.

SALIM AND NEVZAT ACTED TOGETHER

In the indictment, the following evaluation was made regarding the suspect Nevzat Bahtiyar: "It has been determined that the suspect took Narin's lifeless body from the very beginning and placed it in a sack, leaving it in the Eğertutmaz Stream. It has been established that the sack and the sack found in the suspect's barn have similar and consecutive numbers, and it has been determined from the camera recordings that he left Narin's lifeless body at the location where he was found. In his last statement, he claimed that he took the corpse from the residence, which has also been confirmed by the HTS analysis report and the expert report. However, it has been clearly established that the suspect was with Salim before the incident and that they entered Narin's residence together, despite their statements that they did not meet after the incident. The phone examination revealed that they had a conversation at 17:40 on the day of the incident. Given the determination that they entered Narin's residence together and acted together at the time of the incident, it has been clearly established that there was a joint intent to participate in the act of murder, and it has been assessed that sufficient suspicion has been reached regarding their collaboration with the other suspects.

In the evaluation and conclusion section of the indictment, it was stated: "When the camera footage, statement records, forensic reports, crime scene investigation reports, HTS records, HTS narrowed base analysis report, criminal reports, conversation records, data obtained from the examination of mobile phones, police records, and the entire file are evaluated together, it has been determined that the suspects have been in contradictory, contrary to the ordinary course of life, and behaviors that are contrary to the general rules and customs brought by social order and family life since the very beginning of the investigation.

It has been determined that they prevented the discovery of the incident by reporting Narin Güran as a missing child from the very first day and creating contradictions regarding the last time she was seen. On August 21, at around 15:11, Narin, who last entered the camera angle and headed towards the path leading to her home, was found to have reached home at a time when the HTS analysis reports included in the file and the expert report regarding the narrow area base study were taken into account. In light of the clear evidence that all suspects were present at the residence, it has been concluded that the suspects, who were in a unity of time and space, acted with a shared intent in a unity of thought and action, establishing common control over the act of killing, and for an undetermined reason and motive, strangled Narin Güran, committing the crime attributed to them as joint perpetrators. Therefore, it is requested that the suspects be sentenced to aggravated life imprisonment for the crime of 'intentional murder of a child in participation' attributed to them. Additionally, considering the nature of the actions performed by the suspects, the manner in which the incident occurred, and their attitudes and behaviors during and after the act, it was decided that there was no place for the application of Article 62 of the Turkish Penal Code.

In the indictment, the following statements were included:

"All investigation procedures were carried out through the file numbered 2024/46201 of our Chief Public Prosecutor's Office; however, at this stage, considering that the suspects Salim Güran, Nevzat Bahtiyar, Enes Güran, and Yüksel Güran fall under the jurisdiction of the heavy penal court due to the nature and characteristics of the crime attributed to them, and that some investigation procedures regarding certain suspects are ongoing in the main investigation file, a decision for separation has been made regarding our suspects to prevent the file from being left in limbo."
