A new 30-article law proposal submitted to the Turkish Grand National Assembly by AK Party deputies includes critical regulations closely affecting millions of driver candidates. The "probationary driving" system, previously annulled by the Constitutional Court, has been brought back to Parliament's agenda with clearly defined boundaries set by law. According to the new draft, the probationary driving period will be two years, and a blood alcohol level of 0.20 promille will be sufficient for direct license revocation.

30-ARTICLE BILL

In the new 30-article bill submitted to the Turkish Grand National Assembly, which also includes raising the minimum retirement pension to 23,552 liras, radical changes to traffic rules stand out. One of the most important headings of the omnibus law, covering many issues from the restructuring of PTT to retirement pensions, is the 'probationary driver' practice reshaped through amendments to the Highway Traffic Law.

CONSTITUTIONAL COURT HAD ANNULLED IT! RULES ARE NOW DIRECTLY DETERMINED BY LAW

The probationary driver practice had previously been enacted, but the determination of cancellation conditions by a 'regulation' was rejected by the Constitutional Court. The High Court annulled the old regulation, stating that the revocation of a driving license constitutes an intervention into individuals' 'right to respect for private life', that driving has become a part of private life, and that fundamental rights and freedoms can only be limited by law, not by regulation. With the new bill submitted to Parliament, all violations leading to license revocation are directly written into the law text, providing legal assurance.

VIOLATIONS LEADING TO LICENSE REVOCATION IN THE 2-YEAR PROCESS

Those obtaining a driving license for the first time, and those whose licenses have been revoked for any reason and who regain the right to obtain a new license, will be considered 'probationary drivers' for two years from the date of obtaining the license. During this sensitive period, which will be monitored by traffic police, the violations that will lead to the revocation of probationary drivers' licenses are listed as follows:

  • Detection of driving with a blood alcohol level exceeding 0.20 promille, regardless of the vehicle type.
  • Exceeding 75 penalty points as a result of traffic rule violations.
  • Violating any of the following rules three times: violating turning rules, failing to give priority to pedestrians, or failing to comply with the obligation to use protective systems such as seat belts or helmets.
  • Committing any other violation that requires the temporary withdrawal of the driving license under the law.

HOW CAN THOSE WHOSE LICENSES ARE REVOKED GET THEM BACK?

  • Individuals whose probationary driving licenses are revoked due to rule violations will have to complete a challenging process from the beginning to get back behind the wheel. The mandatory conditions for those who want to regain their licenses are as follows:
  • The complete expiration of the 'waiting period' determined due to the revocation or temporary withdrawal of the driving license.
  • Full and complete payment of all administrative fines imposed under the law.
  • Obtaining a health report showing 'no condition preventing driving' by passing a psycho-technical assessment and a psychiatric specialist examination.
  • After all these conditions are met and documents are submitted, re-enrolling in a driving school and obtaining a 'motor vehicle driver certificate' from scratch by successfully passing the exams.
