In the indictment prepared regarding the unauthorized construction of a solar panel and water tank at the villa classified as a First Degree Natural Site Area owned by Şahan Gökbakar, a famous comedian, a prison sentence of 3 to 10 years was requested for 4 people, including him and his brother Togan Gökbakar. ŞAHAN GÖKBAKAR IS IN TROUBLE WITH HIS VILLAThe building registration documents of the villa and its annexes, owned by the Laundry Film Production Inc., in which Şahan Gökbakar is a partner, were canceled on November 9, 2022, by the Building Registration Document Evaluation Commission of the Muğla Provincial Directorate of Environment, Urbanization, and Climate Change due to illegal constructions. Subsequently, a criminal complaint was filed against the owners of the villa due to unauthorized activities. The Marmaris Municipality was also warned to take demolition decisions and to issue demolition notifications to the property owner. The Marmaris Municipality stated that a lawsuit was filed against the cancellation decision at the Muğla 1st Administrative Court on December 15, 2023, and that inspections and determinations would be made according to the outcome of the lawsuit, and information would be provided on the matter. In an official letter sent to the Marmaris Municipality by the Ministry on December 21, 2023, it was reminded of the relevant article in the law, stating that the ongoing lawsuits did not constitute any obstacle to the necessary actions and processes to be carried out regarding the matter. Since the cancellation decision of the Building Registration Document Evaluation Commission dated November 9, 2022, no court has issued a stay of execution or cancellation against the Ministry. DEMOLITION DECISION SENT TO THE MUNICIPALITYIn a letter sent to the Marmaris Municipality on September 6, 2024, it was once again reminded that there was no cancellation or stay of execution decision in the lawsuits filed against the Commission's cancellation decision. Additionally, the Marmaris Municipality was warned once again to carry out the demolition procedures. It was reminded that if the demolition was not carried out by the Marmaris Municipality, it should be carried out by the Muğla Metropolitan Municipality as required by law. If the necessary procedures were not carried out within the timeframes specified by law, information was requested regarding the reasons. Necessary warnings were made to fulfill their responsibilities. "MACHINE AND EQUIPMENT SUPPORT MAY BE PROVIDED"It was reminded that the Muğla Metropolitan Municipality could provide support for demolition under the relevant laws. It was stated that if sufficient equipment for demolition was not available, machine and equipment support could be provided by the Provincial Directorate of Environment, Urbanization, and Climate Change according to the laws. However, if the demolition was not carried out, it was reminded that the demolition costs of the structures could be collected from the relevant Municipality at 100% more by the Ministry. It was stated that if the demolition processes were not carried out by the relevant district municipality and the Muğla Metropolitan Municipality within the legal timeframe, the Ministry had the authority to supervise. SEALEDTeams from the Muğla Directorate of Environment, Urbanization, and Climate Change and the Marmaris Municipality inspected the structure owned by the Laundry Film Production Inc., located in the 'Qualified Natural Protection Area', and sealed the residence and its annexes by preparing a building halt report. INDICTMENT PREPAREDAn indictment was prepared regarding Şahan Gökbakar's unauthorized installation of a solar panel and water tank at his villa located in the First Degree Natural Site Area in Marmaris. According to the indictment, the investigation was initiated after the Muğla Directorate of Environment, Urbanization, and Climate Change filed a criminal complaint against the suspects. In the complaint, it was stated that the suspects made unauthorized physical and construction interventions to the structure located in Turgut Neighborhood. It was emphasized that illegal constructions included a wooden scaffold on a concrete fill, a stone wall, one residential structure, one storage structure, a gazebo, a solar panel, and a water tank. "WE DID NOT MAKE THE IRREGULARITIES, IT WAS LIKE THIS WHEN WE BOUGHT IT"In the indictment, which also included the statements of Şahan Gökbakar, his brother Togan Gökbakar, and Çağrı Özeren, it was noted that the suspects defended themselves by saying, "We bought the property in 2020. We did not make the irregularities; it was like this when we bought it." It was also stated that the previous owner of the property, Osman Bayındır, denied the accusation. GÖKBAKAR FACES UP TO 10 YEARS IN PRISONIn the indictment, it was requested that Şahan Gökbakar, his brother Togan Gökbakar, Çağrı Özeren, and Osman Bayındır be sentenced to 3 to 10 years in prison for violating the Cultural and Natural Heritage Protection Law and causing zoning pollution. The prepared indictment was sent to the Marmaris Criminal Court of First Instance. If the indictment is accepted, the defendants will appear before the judge in the coming days.
