Due to a chain of errors that began with the incorrect registration of his name and gender at birth in Antalya, Ersin Akbaş, who has been known by five different names throughout his life in school, military service, and work life, filed a 'name determination lawsuit' to be able to retire. Stating that he could not access his records and that the court rejected the case, Akbaş said, "I got lost among the 5 names. I opened a determination case for myself to find myself. I am a victim, I want my voice to be heard."
The chain of errors related to the name of 59-year-old Ersin Akbaş, who lives in Antalya, began with his birth. Although the man, who was registered as a girl with the name Ergün at birth, had his record corrected shortly after, the mistakes continued during his school life. Akbaş, who received his primary school diploma with the name Ersun, objected, but his name was written as Ergin on the diploma he received for the second time. According to Akbaş, he served in the military under his own name for 18 months between 1986-1987 and was called up for military service again in 1990 after the mobilization due to the Gulf crisis. Akbaş completed his second military service under the name Ersün. Until this age, Akbaş has lived with the names Ergün, Ersun, Ergin, Ersün, and finally the name he refers to himself as, Ersin Akbaş. FILED A NAME DETERMINATION LAWSUITThe difficulties Akbaş faced due to his name also continued in social security premium payments and job search processes. Most recently, Akbaş and his lawyer filed a name determination and insurance entry lawsuit at the Antalya 9th Labor Court, dreaming of retirement. In the response to the letter sent to Zonguldak SGK, it was stated that there was no record of his mother Şerife Akbaş, whom he claimed to have worked with, regarding tax obligations during the specified dates, and the court decided to reject the case, leaving the way for appeal open based on the report presented by the expert. "I FILED A DETERMINATION LAWSUIT TO FIND MYSELF"Ersin Akbaş, who said, "We filed a determination lawsuit to find ourselves," made a statement to reporters after the trial. He noted that it is very important to make this determination, and that he could be identified from the insurance records and retire. Akbaş stated, "In 1984, I was working insured under the name Ersun with my mother Şerife Akbaş. There is no record of my mother either. She cannot be found. I went to the military in 1986 as Ersin Akbaş, and when I returned, I was called up for military service again in 1990 as Ersün Akbaş. Despite saying what I did, I had to do it again because the records were not visible. If I am guilty, I am ready to be executed. If the documents at the Çaycuma Military Branch or the tax office are checked, everything will be resolved. I am 59 years old, and I cannot retire," he said. "ERSİN HAS INSURANCE, ERSÜN DOES NOT SEEM TO HAVE"Expressing that he is very victimized, Akbaş concluded his words as follows: "I got lost among the 5 names. Ersün Akbaş has insurance from 1984, and I also paid taxes to the state in 1991. I was a tax payer with my current name Ersin Akbaş, I was under Bağ-Kur, and when I go to pay my debt, they do not accept it. I want to combine Ersin and Ersün to retire. I already have 5,330 days with my name Ersin, but there are none for Ersün. I have not left anyone I haven't informed about this. Please let the authorities hear my voice. What will I do? I am very victimized. Ersin was born in 2006. The other names have lived. I have one TC number for my 3 names. I have respect for my state and government. I believe they will solve this issue. I am really very tired." "INSURANCE CANNOT BE DETERMINED BECAUSE NAMES CANNOT BE IDENTIFIED"Akbaş's lawyer Nuray Ertem stated that they filed a determination lawsuit to prevent the confusion of names and insurance due to past mistakes, but the court rejected the case because they could not access the records. Ertem stated that they would appeal, saying, "If necessary, we will request the records from state archives. Insurance cannot be determined because names cannot be identified, as they appear as different people and different insurances come up. At certain dates, there are insurance entries as Ersun, and at other dates as Ersin, but they cannot be combined," she said.
