The father, who video-called his spouse during their divorce proceedings and held a knife to their children's throats, was released at the first hearing.
Şiyar Alpaslan, who video-called his wife Fatma Alpaslan, who is in the process of divorce in İzmir, and threatened their children by holding a knife to their throats, was released at the first hearing. After reading the decision, the judge warned Alpaslan to be a good father to his children and not to take out his problems with his wife on them.
HE VIDEO-CALLED HIS WIFE AND THREATENED HIS CHILDREN WITH A KNIFE
Fatma Alpaslan, who decided to divorce due to incompatibility in the city, left her two children with her husband Şiyar Alpaslan and went to Burdur. On November 18, 2024, Şiyar Alpaslan video-called his wife Fatma Alpaslan and threatened their children Y.C.A. and B.A. by holding a knife to their throats. Fatma Alpaslan went to the police and filed a complaint. The teams that took action detained Şiyar Alpaslan in the Karabağlar district. While the children were taken into state protection, Şiyar Alpaslan was arrested by the court after his procedures. After the necessary investigations, the children were handed over to their mother.
INDICTMENT ACCEPTED
After the incident, the investigation was completed, and the indictment was prepared. The indictment emphasized that the Alpaslan couple had a divorce case in the Milas 2nd Family Court. It was stated in the indictment that on the day of the incident, the defendant video-called Fatma Alpaslan and sent a message saying 'Answer urgently', after which Fatma Alpaslan answered the phone. During the video call, Şiyar Alpaslan pointed to B.A. and asked, 'Which of the children do you want to die?' It was emphasized that he injured B.A.'s face in a way that could be treated with simple medical intervention. The indictment also stated that the defendant threatened Fatma Alpaslan by holding a knife to B.A.'s throat, asking, 'Is it burning inside you? Should I cut your throat? Do you want to watch it live?' In light of the statements and collected evidence, the prosecutor requested a total of up to 6.5 years in prison for Alpaslan for 'intentional injury' and 'threat with a weapon', and the indictment was accepted by the İzmir 29th Criminal Court of First Instance.
"I GAVE IN TO MY ANGER"
The trial of the defendant Şiyar Alpaslan began today at the İzmir 29th Criminal Court of First Instance. The detained defendant Alpaslan participated in the hearing via the Audio and Visual Information System (SEGBİS), while lawyers and members of the We Will Stop Femicide Platform were also present in the courtroom. In his statement during the hearing, defendant Alpaslan said, "I am very sorry for what happened. The reason for this incident is my wife's infidelity. An hour before this incident, my wife sent me a photo with the man she ran away with. I went crazy at that moment. After that, I got angry. She video-called me and said, 'I don't want those children of yours, kill them.' I gave in to my anger, and this incident happened."
REQUEST FOR INCOMPETENCE REJECTED
The complainant's lawyer, Nevraz Zeliha Sığın, who spoke at the hearing, requested the court to declare 'incompetence'. Lawyer Sığın stated, "We believe that the act in question constitutes attempted murder. For this reason, the case should be heard in the heavy penal court. We request your court to declare incompetence." The judge, who evaluated the request, decided to reject the 'incompetence' request.
JUDGE'S WARNING TO THE DEFENDANT
The prosecution, which presented its opinion at the hearing, suggested the release of the defendant Şiyar Alpaslan, considering the time he spent in prison. After the opinion, an interim decision was announced. The judge, who decided to release the defendant, ruled that the deficiencies in the file should be corrected and postponed the hearing to April 24. After reading the decision, the judge warned the defendant to be a good father to his children and not to take out his problems with his wife on them.
