The suspect, who was on trial on allegations that he sexually abused the 12-year-old daughter of the woman he lived with in a religious marriage in Antalya for a year, was sentenced at the final hearing to 30 years in prison for the offense of 'qualified sexual abuse of a child.' The mother, expressing satisfaction with the verdict, said, 'It was an exhausting fight for my child and me. In the end, thanks to my lawyer and the evidence, we proved it. I am about to cry; I am very happy.'
In Antalya, what happened to a girl who was sexually abused by the man her mother lived with in a religious marriage came to light through the statement she made to her guidance teacher. O.E. (47), who was tried for the abuse that continued for about a year, was sentenced to 30 years in prison for the crime of qualified sexual abuse of a child.
HE ABUSED THE DAUGHTER OF HIS RELIGIOUSLY MARRIED WIFE The incident occurred in Antalya. According to the allegation, O.E. (47), with whom S.S. lived in a religious marriage, sexually abused the woman's 12-year-old daughter in the house where they lived together. The girl was a fourth-grade primary school student at the time of the abuse. The suspect, who also abused the child while the child's mother and sibling were sleeping, gave her money and asked her not to tell her mother what had happened. The suspect, who was stated to have continued the abuse for 1 year, frightened the child by saying that she would be sent to a children's home if she told anyone what had happened, and also threatened the child by saying, "I will kill your mother."
The child, who hid what had happened for a while because she was afraid, later told her mother and guidance teacher about the situation. The mother filed a complaint with the police against the person she stated had sexually abused her daughter. Upon the complaint, an investigation was launched by the Antalya Chief Public Prosecutor's Office.
While she was going to the police with her mother, the child, who tried to hide what had happened because she was afraid of the suspect, described the abuse in her statement taken at the Child Monitoring Center. As part of the investigation, the child's guidance teacher was also asked to give a statement. The teacher stated that in her interview with the child, her student told her that the person her mother lived with had sexually abused her.
In the indictment prepared by the Antalya Chief Public Prosecutor's Office after the investigation, the statements of the child and her mother, witness statements, and the scope of the case file were evaluated together. While the prosecutor's office requested that the defendant be punished on the grounds that he had sexually abused the child repeatedly, it also requested that, if he received a prison sentence, some of his rights, such as holding public office, be restricted.
THE DECISION HEARING WAS HELD Following the incident, the decision hearing was held in the case filed at the Antalya 3rd High Criminal Court. The child's mother, S.S., and the parties' lawyers attended the hearing. O.E., who was being tried without detention in this case, did not attend the hearing. It was alleged that the defendant, who was in prison for another crime, was outside on leave on the day of the hearing.
At the hearing, the prosecutor, repeating his previous opinion, evaluated the statements of the child and her mother and the accounts of the guidance teacher, and requested that the defendant be punished for the crime of 'qualified sexual abuse of a child'; he also requested an increase in the sentence because the abuse was committed more than once.
The court panel first sentenced the defendant to 18 years in prison for the crime of 'qualified sexual abuse' against the child, who was under 12 at the time of the crime. With the increases made because the crime was committed with threats and more than once, the sentence rose to 33 years and 9 months. However, due to the legal upper limit, the defendant's sentence was set at 30 years in prison. The panel did not apply a reduction in the sentence because no positive opinion was formed that the defendant would not commit a crime again, given his past convictions. Considering the length of the sentence imposed and the suspicion that the defendant might flee, the court ruled that judicial control would not be sufficient and decided to issue an arrest warrant for O.E.'s detention.
SHE TOLD HER GUIDANCE TEACHER Hande Amioğlu, the lawyer for the victim child, who made a statement after the decision hearing, said: "For us, this was not just continuing the criminal proceedings or following the process; it was about standing by a child in her search for justice in the criminal proceedings. Our child expressed the problems she experienced to her guidance teacher, and thanks to her teacher's responsible behavior, this situation was reported to the family. We have a child living with a single parent; after the mother learned of this process, she applied to us, and we filed a complaint."
Amioğlu, who said that the child tried to hide what had happened because she was afraid of the defendant, noted that what happened came to light through the statement taken at the Child Monitoring Center accompanied by pedagogues, and that the trial was concluded.
"I WAS KIDNAPPED AND BEATEN BECAUSE I DID NOT WITHDRAW THE COMPLAINT" S.S., a mother of two, said that she had a religious marriage relationship with the defendant for 2 years. Stating that her daughter told her guidance teacher what had happened and that the teacher informed the child branch, S.S. said: "The child branch called me, and I started the judicial process. This person had about 8-10 million TL of my money; I was told to withdraw the complaint and take my money. A lot of pressure was applied, but I never gave up. Because I did not withdraw the complaint, I was kidnapped and beaten. Trials were held regarding this, and he received prison sentences for crimes such as deprivation of liberty and violence."
"I STOOD BY MY CHILD UNTIL THE END" S.S., who expressed that she was pleased with the verdict, continued as follows:
"I lost my home, everything, but I stood by my child until the end. It was an exhausting war for my child and me. In the end, thanks to my lawyer and the evidence, we proved it. I am about to cry; I am very happy. I hope no one experiences what I experienced. This decision should set an example; no one should lay a hand on anyone else's child. They are babies; they are innocent. I am very pleased with the verdict; thank goodness justice exists, thank goodness there are prosecutors at the head of this state."
