The bill concerning fund liquidation was adopted at the General Assembly of the Turkish Grand National Assembly.
FUND BILL PASSES PARLIAMENT
The General Assembly of the Turkish Grand National Assembly adopted and enacted the 9-article Bill on Certain Investment Funds Decided to Be Liquidated, prepared to remedy the grievances experienced in liquidated investment funds. With the regulation, it is aimed to significantly accelerate the payment process for citizens affected by the fund crisis and to overcome bureaucratic obstacles.
PAYMENT UP TO 1 MILLION LIRA
Under the new law, priority payments of up to 1 million Turkish lira will be made to eligible individual investors. Thanks to this process, which will be carried out without waiting for lengthy liquidation procedures, investors will be able to obtain their money in a much shorter time.
According to the bill that became law, the liquidation of the funds will be carried out by institutions responsible for liquidation under the supervision and audit of the Capital Markets Board (CMB).
For funds determined by the CMB, interim payments may be made to investors from the liquidation assets of the relevant fund. For investors whose net investment amount is below 1 million lira, interim payments may be made up to this amount, and for investors whose net investment amount is 1 million lira or more, an interim payment of at most 1 million lira may be made.
NO PAYMENTS TO THOSE INVOLVED IN MARKET FRAUD
Within the scope of the bill, no payments will be made to persons determined to have committed market-disrupting actions, insider trading, or market fraud in connection with the funds whose liquidation was decided by the CMB's decisions dated September 17, 2026.
If these acts are committed by the funds in question, carried out in concert with the funds, or carried out with the participation of the funds, persons determined by the CMB to have committed the acts or acted in concert may not benefit from the funds' liquidation and recovery account.
In investigations conducted due to acts connected with the funds within the scope of the regulation, seizure decisions may be issued pursuant to the relevant provisions of the Code of Criminal Procedure (CCP).
LOSS AND DAMAGE AMOUNTS WILL BE DETERMINED
In situations not covered by the provisions concerning seized and confiscated asset values and the recovery account, the CMB will take into account the liquidation proceedings and the results of audits and investigations.
The Board will determine, for each fund, the amount of damage or loss, the natural and legal persons responsible for such damage or loss, and the amounts for which they are responsible, and will notify the Savings Deposit Insurance Fund (SDIF).
The amounts accumulated in the recovery account, after deducting mandatory expenses, will be transferred by the SDIF to the institution responsible for liquidation. If the liquidation has been completed, the amounts in question will be sent to the Investor Compensation Center (ICC) to be paid to the fund shareholders notified by the CMB.
The ICC will make payments in proportion to participation share ownership. According to the regulation, the portfolio management company that is the founder and/or manager of the fund will be held primarily responsible for the damage or loss.
