In Eskişehir, the defendant, who was tried on the allegation that he attempted to kill his wife by burning her, was acquitted of attempted intentional homicide against a woman. The court deemed the defendant's act to fall within the scope of intentional injury against a woman and spouse and imposed a judicial fine of 33,700 TL.

In Eskişehir, the defendant, against whom a case was filed on the allegation that he attempted to kill his wife by burning her, was acquitted of the crime of "attempted intentional killing of a woman," while his act was evaluated within the scope of injury and he was sentenced to a judicial fine of 33,700 TL.

At the final hearing held at the Eskişehir 5th High Criminal Court, defendant Kutlu A. and the parties' lawyers were present in the courtroom. In its opinion on the merits, the prosecution stated that the defendant's act against complainant Esma A. constituted the crime of attempted murder and requested that he be punished in accordance with the relevant articles of the Turkish Penal Code (TCK).

"THE PARTIES HAVE RECONCILED, THEY HAVE A HAPPY MARRIAGE"

Making a defense against the opinion, the defendant's lawyer did not accept the accusations and requested his client's acquittal. The lawyer, arguing that the incident was not an attempted murder as alleged, said: "My client and the complainant have already reconciled and have a happy marriage. They currently live together in a caravan. While a man who wanted to kill a woman in a home environment would have the opportunity to do so with a knife he would take from the kitchen or an object he could get his hands on, the allegation that he attempted to kill her by burning her is contrary to the ordinary course of life. Considering the extent of the assault allegations and the complainant's contradictory statements at the stages of the proceedings, it is clear that the act cannot be interpreted as attempted murder. We request my client's acquittal."

ACQUITTAL OF ATTEMPTED MURDER, JUDICIAL FINE FOR INJURY

The court panel announcing its decision issued an acquittal in the public case filed against defendant Kutlu A. for the crime of "attempted intentional killing of a woman" on the grounds that the offense charged was not proven to have been committed by the defendant. Convinced that the defendant's act against his wife constituted the crime of "intentional injury against a woman and spouse," the panel applied the relevant articles of the TCK and discretionary mitigation provisions and sentenced the defendant to a judicial fine of 33,700 TL.
