According to the arrest report, Winstead admitted to using drugs throughout the day before getting into the bathtub with her baby.

The mother, who was awakened hours later by another person in the room, realized that her baby had drowned. The only witness to the incident, the baby's sister, told the police in her statement that her mother had fallen asleep while holding her sibling in the bathtub.
