The Grand Chamber of the European Court of Human Rights (ECtHR) will announce its decision tomorrow on the second application of Osman Kavala, a Gezi trial convict arrested in 2017.
The European Court of Human Rights (ECHR) Grand Chamber will announce its decision tomorrow on the second application of Osman Kavala, who was arrested in 2017 and convicted in the Gezi trial.
ALLEGATIONS IN THE APPLICATION
The ECHR's decision in the case "Kavala v. Türkiye (no. 2)" covers Kavala's application alleging violations regarding his detention after the 2019 ECHR decision and the trial process that resulted in an aggravated life sentence.
In his application, Kavala alleged violations of the European Convention on Human Rights regarding the right to liberty and security, the right to a fair trial, no punishment without law, freedom of expression, freedom of assembly and association, and the prohibition of inhuman or degrading treatment. The application also stated that Article 18 of the ECHR, which prohibits the use of restrictions on rights and freedoms for purposes not envisaged, was violated.
DECISION ALSO MADE IN 2019
In 2019, the ECHR ruled that Kavala's detention was unlawful and that he should be released, but Kavala was not released. In 2022, the Grand Chamber decided that Türkiye had failed to fulfill its obligation to comply with that decision.
SENTENCED TO AGGRAVATED LIFE IMPRISONMENT
As a result of the ongoing trial in Türkiye, Kavala was sentenced to aggravated life imprisonment on April 25, 2022, for the crime of "attempting to overthrow the government" in connection with the Gezi Park protests, and the decision was upheld by the Court of Cassation in 2023, becoming final.
The Grand Chamber held the hearing regarding Kavala's second application in Strasbourg on March 25. The decision will be announced at a public session at the Human Rights Building in Strasbourg tomorrow at 10:00 AM.
