The Ministry of Health intervened in the investigation regarding a maternal death after childbirth at a private hospital in Şanlıurfa. Reminding that permission from the Professional Responsibility Board must be obtained to initiate legal proceedings against healthcare workers in the incident where the doctor was arrested, the ministry made a statement.

Edanur Yaman, who died after giving birth at a private hospital in Şanlıurfa, lost her life while receiving treatment at the hospital. Within the scope of the investigation into her death, obstetrics and gynecology specialist Dr. Münevver Zehra Davutoğlu was arrested. Following the doctor's arrest, the Ministry of Health intervened in the investigation.

"INVESTIGATION SUBJECT TO SPECIAL PERMISSION"

In a statement from the Ministry of Health, it was stated that criminal investigations to be conducted against healthcare professionals due to their medical procedures and practices are subject to a special permission procedure as a result of significant amendments made by the Turkish Penal Code and the Law on Amendments to Certain Laws.

The statement emphasized that, according to Additional Article 18 added to the Basic Law on Health Services, investigations into medical procedures and practices related to examinations, diagnoses, and treatments performed by physicians, dentists, and other healthcare professionals working in public or private health institutions within the scope of their profession can only be carried out if the Professional Responsibility Board grants permission for the investigation.

The statement included the following expressions:

"Therefore, without obtaining investigation permission, which is a condition for prosecution, no judicial process can be initiated against the relevant healthcare professional, and protective measures cannot be decided. Within the framework of the above explanations, our Ministry has intervened in the investigation initiated regarding the proceedings and actions that occurred due to medical procedures and practices at a private hospital in Şanlıurfa, resulting in the death of a citizen."
