In Şanlıurfa, Dr. Münevver Zehra D., an obstetrics and gynecology specialist who was arrested as part of an investigation into the death of Edanur Yaman after she gave birth at a private hospital and was referred to another hospital where she died, has been released under judicial control. The Ministry of Health had objected to the arrest of the female doctor, who was detained yesterday.

A new development occurred in the investigation into the death of Edanur Yaman, who died in the hospital where she was treated after giving birth at a private hospital in Şanlıurfa.

SHE DIED 2 DAYS AFTER GIVING BIRTH

Edanur Yaman gave birth at a private hospital in the city on July 14 at around 11:30. After the birth, Yaman was kept under observation at the hospital for a while, but her health condition worsened shortly after. Edanur Yaman was transferred to Harran University Hospital the next day. She was taken into intensive care there and passed away on July 16 at around 01:00.

The Şanlıurfa Chief Public Prosecutor's Office launched an investigation following a complaint from Edanur Yaman's family. Within the scope of the investigation, Dr. Münevver Zehra D., the obstetrician and gynecologist who performed the birth, was taken into custody. After her procedures at the police station, Dr. Münevver Zehra D. was referred to the courthouse and was arrested by the Duty Criminal Court of Peace and sent to prison.

Dr. Münevver Zehra D.'s lawyer appealed the decision. The Criminal Court of First Instance, evaluating the objection, decided to release Dr. Münevver Zehra D. under judicial supervision.

Within the scope of the investigation into the death of Edanur Yaman, who died after giving birth at a private hospital in Şanlıurfa, obstetrician and gynecologist Dr. Münevver Zehra Davutoğlu was arrested. Following the doctor's arrest, the Ministry of Health intervened in the investigation.

"INVESTIGATION REQUIRES SPECIAL PERMISSION"

In a statement from the Ministry of Health, it was stated that criminal investigations to be conducted regarding the medical procedures and practices of healthcare professionals have been subjected to a special permission procedure as a result of the fundamental amendments made by the Turkish Penal Code and the Law on Amendments to Certain Laws.

The statement emphasized that, according to Additional Article 18 added to the Basic Law on Health Services, investigations into physicians, dentists, and other healthcare professionals working in public or private health institutions, related to medical procedures and practices concerning examination, diagnosis, and treatment within the scope of practicing the medical profession, can only be conducted if the Professional Responsibility Board permits the investigation.

The statement included the following expressions:

"Therefore, without obtaining the investigation permit, which is a condition for prosecution, no judicial process can be initiated against the relevant healthcare professional, and protective measures cannot be decided. Within the framework of the above explanations, our Ministry has intervened in the investigation initiated regarding the procedures and transactions that resulted in the death of a citizen due to medical procedures and practices at a private hospital in Şanlıurfa."
