On April 14, 2020, the son of 73-year-old pharmacist Birsen Bayraktar, who lived alone in the Karşıyaka district of İzmir, and her neighbors reported her missing to the police. Police teams, who entered the house with a locksmith, found Bayraktar's lifeless body. Initial examinations suggested that the pharmacist died as a result of a fall, but the autopsy revealed that she had been murdered. The report from the Forensic Medicine Institute dated December 18, 2020, stated that Bayraktar died due to blunt force trauma leading to a fracture in the dome bone, bleeding between the brain membranes, and pressure applied to her neck.
THE SHOE IN FRONT OF THE DOOR DISAPPEARED BEFORE THE INCIDENT
The Homicide Bureau teams of the Public Security Department worked for four years to solve the murder. Police teams learned from neighbors' statements that sounds were heard from Bayraktar's house on the day of the incident, and they rang the doorbell. During this time, they saw a shoe resembling a work safety shoe in front of the door, but when the door did not open, they went upstairs and found that the shoe was gone when they returned.
THOUSANDS OF DATA WERE EXAMINED
The incident was assessed to have occurred on the evening when neighbors heard noise, one day before the body was found. Homicide Bureau detectives repeatedly watched 96 hours of footage from a camera that monitored the entrance of the building. It was determined that no foreign person entered or exited the building. Detectives examined 116,300 data and 6,500 photos found on Bayraktar's mobile phone one by one.
THE SHOE BELONGED TO THE JANITOR
The police focused on two photos from Bayraktar's phone. In a photo taken with Birsen Bayraktar's mobile phone, it was determined that the shoe worn by the building's janitor, Uğur C., was the same as the one the neighbors said they saw in front of the door. The teams also learned from the statement of Uğur C.'s wife, Müjde C., that the shoe was thrown away the day after the murder. However, it was noted that the $4,000 and 22,800 TL in cash in the murdered Bayraktar's house were untouched. The police then focused on the theory that the suspects panicked and fled without taking the money after the neighbors rang the doorbell.
3 SUSPECTS DETAINED WERE RELEASED
Police teams detained Uğur C., the janitor of the building, his wife Müjde C., and electrician Hakan H., who lived in the same apartment and was also involved in the building's repair work, as suspects on May 6 last year. The suspects were released by the Duty Magistrate after their procedures.
INDICTMENT COMPLETED AFTER 4 YEARS
The Karşıyaka Chief Public Prosecutor's Office completed its investigation related to the incident and prepared an indictment against the three suspects on December 24. In the 38-page indictment, life imprisonment and up to 15 years in prison were requested for janitor Uğur C. and electrician Hakan H. for "intentional murder" and "attempted robbery," while a prison sentence of up to 5 years was requested for Müjde C. for "aiding a criminal."
WITHDREW ALL HIS MONEY A DAY BEFORE THE INCIDENT
The indictment also included the findings of the police and the prosecutor regarding the murder. According to the statements of her relatives, it was noted in the indictment that the murdered Birsen Bayraktar constantly locked the lower and upper locks of her house and did not let anyone she did not know into her home. It was also determined that Bayraktar, who could not leave her house due to the pandemic at that time, received help from janitor Uğur C. and electrician Hakan H. for grocery shopping. The indictment pointed out that Birsen Bayraktar was afraid due to a false information she received that savings would be seized due to the pandemic, and therefore, one day before the incident, she went to the bank with Hakan H. to withdraw her $4,000 and 22,800 TL. The indictment also noted that when she previously went to visit her son in Ukraine, some of the gold in Birsen Bayraktar's house was stolen.
HE TOLD HIS WIFE "I WILL STEAL BIRSEN HANIM'S MONEY"
The statement of janitor Uğur C.'s wife, Müjde C., was included in the indictment. Müjde C. stated, "Birsen Bayraktar had a very good relationship with my husband. She would call my husband for any kind of need. Hakan H. was the one who handled Birsen Hanım's money withdrawal from the bank. She trusted him a lot. He also frequently entered her house. The day before the incident, my husband told me that Hakan withdrew money from the bank with Birsen Hanım. Then he said he would steal Birsen Hanım's money. I got angry with him. I said, 'We don't need the money, don't do such a thing.' He did not respond to me," she said.
"IF SOMEONE SEES THE SHOE, I'LL BE IN TROUBLE"
In the continuation of Müjde C.'s statement, she mentioned that the police looked at her husband Uğur C.'s shoe and took a photo of it, saying, "Later, my husband was questioned. When he returned home, he asked me, 'Why did you show this shoe to the police?' Then he threw this shoe in the trash. I asked him, 'If you are innocent, why did you throw the shoe in the trash?' He said, 'That shoe was the one in front of the house, if someone sees it, I'll be in trouble. Janitors are always guilty in such situations,' he said. After this incident, my husband's meetings with Hakan also continued," she noted.
CONTRADICTORY STATEMENTS
The indictment also addressed various findings and contradictions related to the incident. It was stated that Birsen Bayraktar told suspects Hakan H. and Uğur C. that she withdrew all her money from the bank, and that on the night of the incident, suspect Uğur C. falsely claimed that he had gone home even though he had not. Unlike Uğur C., Hakan H. stated that he was with Birsen Bayraktar on the night she was murdered.
WHEN HE SAW THE BODY, HE SAID "WHO DID THIS TO YOU"
It was noted that the electricity in Birsen Bayraktar's apartment was cut off and that only suspect Uğur C. had the main switch keys for the electrical panels and apartments in the attic. When the law enforcement officers entered, the apartment had no electricity. It was pointed out that Uğur C. turned on the electricity of the murdered Bayraktar's apartment from the electrical panel in the attic, which allowed the law enforcement officers to start their work. When the law enforcement officers first entered the apartment, it was understood from the locksmith's statements that Birsen Bayraktar, who was lying on the floor, might have had a health issue or fainted, but suspect Uğur C.
``` It was stated that the person who carried out the act against Bayraktar indirectly confessed by saying, "Who did this? Aunty Birsen, we were together just yesterday. We didn't hear anything at all. I did my job just last night. What happened to you, who did this to you?" Uğur C. and Hakan H. were noted to be the individuals who brought the murdered Bayraktar to his home, despite their defenses denying this. REQUEST FOR ARREST WARRANTIn the indictment, it was emphasized that Uğur C. and Hakan H., who were referred to the Duty Magistrate's Court with a request for arrest during the investigation phase, were released without even being subjected to judicial control conditions despite sufficient material evidence being present. It was requested that an arrest warrant be issued for them. Additionally, it was requested that security measures, primarily a travel ban abroad, be imposed on Hakan H. "I WILL FOLLOW THIS TO THE END"Bayraktar's son in Ukraine, Kafkas Gence Karadağoğlu, requested the heaviest punishment for the defendants who killed his mother, stating, "I trust in justice. I will follow this matter to the end."
