In the appeal made by Salim Güran's lawyer, Onur Akdağ, to the Diyarbakır 8th High Criminal Court, a new detail has emerged regarding Nevzat Bahtiyar, who has been a subject of controversy due to the sentence he received. In Güran's petition, it was claimed that Nevzat Bahtiyar's daughter was kidnapped and made pregnant by the grandson of M. S. K., a former muhtar, four years ago. Following this, it was stated that Nevzat Bahtiyar, along with his six siblings, stormed the former muhtar's house with heavy weapons and attempted to strangle the former muhtar.

Narin Güran, whose lifeless body was found in a sack in the riverbed on the 19th day of the search efforts after going missing in the rural Tavşantepe neighborhood of the Bağlar district on August 21, was covered with three stones weighing 30, 25, and 20 kilos and hidden with bushes. A case has been opened at the Diyarbakır 8th High Criminal Court against four of the twelve people arrested in connection with Narin Güran's murder.

4 PEOPLE RECEIVED SENTENCES

In the indictment prepared by the Diyarbakır Chief Public Prosecutor's Office, it was stated that Salim Güran, whose vehicle contained DNA and hair samples belonging to Narin, along with his mother Yüksel Güran and brother Enes Güran, were taken into custody. It was also mentioned that neighbors Nevzat Bahtiyar, who confessed to transporting the body to the riverbed after being detained, were found to be in the same house at the time of the incident according to HTS and base station records. An aggravated life sentence was requested for the crime of 'intentional murder of a child in participation.' In the second hearing of the case, which started on December 26 and ended on December 28, Salim Güran, Enes Güran, and Yüksel Güran were sentenced to aggravated life imprisonment for 'intentional murder of a child in participation,' while Nevzat Bahtiyar received a 4-year and 6-month prison sentence for 'destroying, concealing, or altering evidence.' The court ruled for the continuation of the defendants' detention.

APPEAL FROM HIS LAWYER

Salim Güran's lawyer, Onur Akdağ, submitted an appeal to the Diyarbakır Regional Court of Justice to be presented to the 8th High Criminal Court. In the petition, it was stated that the investigation was conducted inadequately, emphasizing that "The decisions made regarding the deficiencies and errors of the public prosecutors are not negligible. When these decisions are examined in general, it is seen that especially the evidence related to the incident was not collected quickly, the investigation was conducted by law enforcement officers who were accused, and there was a lack of coordination among different public prosecutors conducting the investigation. On the other hand, the failure to ensure the active participation of the victim and complainants in the investigation, the autopsy and examinations not being conducted by experts, the inadequacy of the crime scene investigations, the ineffective taking of statements, and the failure to photograph the crime scene are among the notable deficiencies in the investigations. The investigation initiated with the loss of the victim Narin on August 21 was conducted in a deliberately and negligently one-sided and incomplete manner. The loss of our daughter Narin has deeply affected us all. From the moment the law enforcement and public prosecutors took over the case, countless chains of negligence have caused the file to become unmanageable. The investigation authorities did not look where they should have, the essential evidence that needed to be collected was not gathered, and the surrounding cameras, including those in the military base area, were not examined in time, resulting in our daughter Narin not being found for a full 19 days. Consequently, during this period, the actual perpetrator could not be reached either. From the very first day of the incident, law enforcement directly suspected the family, like the first link created by a stone thrown into the water, wrote unnecessary reports on the family, and attempted to cover up their incompetence by reporting unfounded opinions that the family was organizing the search efforts." it was stated.

In the petition, which stated that a suitable environment for the murder was created, it was noted, "On the day of the incident, 44 members of the Güran family went to Derik, Batman, and Diyarbakır to distribute the wedding invitations of Uğurcan Güran. Nevzat Bahtiyar learned about this situation in the morning, planned the murder, and carried it out. Nevzat Bahtiyar learns from his mother, Zeynep Bahtiyar, that the men in the village will leave the village for the wedding invitations. Because Zeynep Bahtiyar asked Kurtuluş Güran, who went to distribute the invitations, one by one who would go where that morning. Unfortunately, life does not tolerate a vacuum. If we are to look for a crime in this family, unfortunately, it is the complete evacuation of the village that day and the surrendering of the lamb to the wolf. The atrocity and ruthlessness committed by Nevzat are evident. We are 100% sure that this brutality was committed by Nevzat Bahtiyar. None of Nevzat's statements corroborate each other. "HE TRIED TO STRANGLE THE FORMER MUHTAR AS WELL"

In the petition, which stated that there was a previous attempt to strangle, it was noted, "Nevzat Bahtiyar has a savage power, having surrounded the former muhtar's house with his six siblings armed with heavy weapons when his daughter was kidnapped and made pregnant by the grandson of M. S. K., a former muhtar, four years ago. Even more interestingly, Nevzat Bahtiyar attempted to strangle the former muhtar with his own hands. If Salim Güran had not saved the former muhtar from Nevzat, he would have met the same fate as Narin. We requested that the former muhtar be heard as a witness in court to demonstrate this similarity of actions. However, this request was not accepted. Now it is said, if Nevzat did it, why didn't you say it was Nevzat first? After the child went missing, Nevzat plays a role. He comforts himself in front of Arif, saying, 'God is great, don't be sad, she will be found,' offers him a cigarette, and they pray together, patting each other's backs.

However, the local court, which concludes that this child was killed in participation by her family with a complex plot that has not yet been identified and consists of scenarios in such a short time frame, does not ask or investigate why Nevzat spent exactly 38 minutes and 11 seconds in the stream, nor does it have him perform a reenactment. Nevzat Bahtiyar passes at 15:41:56. He is on the stabilized road at 15:44. He turns back at 16:22. In other words, he is there for a long period of exactly 38 minutes and 11 seconds. "BASE REPORTS ARE FAULTY"

In the petition, it is stated that the base records prepared and submitted to the court are faulty, and it is claimed that "The base report has been intentionally prepared against my client. According to the base report dated December 3, it is claimed that when base work is done within the village, it receives signals from at least 22 bases, and therefore the detections are indisputably certain. Now we ask, how can someone inside the village's bases appear 2-3 kilometers outside the village? If you claim to have received signals from at least 22 bases, how does Salim's base go outside the village between 22:48 and 22:55? The same report has detected my client along with the other defendants in Arif's house room by room, point by point, but has positioned my client around the cornfield at 22:47. Why could the exact coordinates not be determined then? The report states that the detections in question are not based on interpretation and are entirely based on mathematical calculations. However, as we explained above regarding the Eğertutmaz issue, we are faced with the reality that the report is based on interpretation, even intentionally prepared, and unfortunately still used as the basis for the judgment. The names of those who prepared the report are not on the regional expert list. What is the area of expertise of these experts? There are 16 regional expert boards, and these individuals are not on the expert list either. What are the qualifications and areas of expertise of those who prepared the report? We do not know any of this. We do not know the professions, areas of expertise, and most importantly, who the people who prepared this report are. As the defense, we cannot verify the reliability of the report. The base report paints such a picture that it almost shows Tavşantepe as the area with the widest coverage in Turkey. This is why we insist that a report should be prepared with the participation of the local court during the inspection. Because there is no need to be an expert; in the village, let alone the internet, even phones do not work in many places. Location information can be seen with at least a 200-300 meter deviation," it was stated.

ACQUITTAL REQUESTED

In the petition, it is requested that Salim Güran be acquitted, and the following statements were included:
