After the footage emerged, the arrested individual was later released, but following public outcry, he was re-arrested. REQUEST FOR UNJUST PROVOCATION DISCOUNTAccording to a report in Sabah, the penalty for the perpetrator, who spent only 12 days in prison and appeared before a judge, has been determined. The public prosecutor noted in his opinion that the victim child was unable to defend himself and that the defendant committed the act with violent and monstrous intent. However, it was stated that the child admitted to cursing, and a request for a reduction in the sentence was made on the grounds that the defendant acted under unjust provocation. The ministry's lawyer requested that the defendant's actions be evaluated as "attempted murder" and that a decision of lack of jurisdiction be made. COURT'S "NO CRIME COMMITTED" SUSPENSION AND RELEASEThe court determined that the crime of "intentional injury" was committed against a victim who was unable to defend himself, sentencing the defendant to 1 year and 6 months in prison.
