In Ankara, regarding the case of 13-year-old Beren Su Bolat, who lost her life after falling into the elevator shaft during a rescue operation by the fire department while she was trapped in the elevator, the prosecutor requested up to 6 years of imprisonment for 4 defendants, including 3 firefighters, who are being tried for the crime of 'manslaughter by simple negligence,' instead of the initial charge of 'causing death and injury by conscious negligence' for which they faced 22 years and 6 months in prison.

On July 23, 2024, Beren Su Bolat (13), who was going to the apartment where her classmate lived in the Fevzi Çakmak neighborhood of Sincan district in Ankara, got stuck in the elevator between the 5th and 6th floors with her friend. During the firefighters' efforts, Beren Su fell into the elevator shaft and died, while her friend was rescued.

REQUEST FOR UP TO 22 YEARS AND 6 MONTHS IN PRISON

As part of the investigation, fire chief Ercan Y., firefighters Bayram B. and Buğra Y. were arrested. A lawsuit was filed against the 3 defendants for the crime of 'causing death and injury by conscious negligence' with a request for up to 22 years and 6 months in prison.

RELEASED WITH 'JUDICIAL CONTROL'

In the second hearing held on January 17, the court panel decided to release the detained defendants with the judicial control measure of 'prohibition of leaving the country.'

NEW REPORT REQUESTED

In the third hearing of the case held at the Ankara West 5th Heavy Penal Court, the defendants who were not in custody, apartment manager Yılmaz G. and firefighters Bayram B., Buğra Y., Ercan A., along with their lawyers, attended.

The defendants' lawyers claimed that all defendants were accused with general statements regarding the expert report and stated that they did not agree with the report, requesting a new report to be obtained.

The lawyer of the Bolat family, Eda Er Yıldırım, stated, "It is clear that all three firefighters intervened incorrectly in the incident, and none of them intervened regardless of rank. There is no explanation for the incorrect start of the intervention. This is not a work accident; there is a primary fault. There is an expert report suitable for establishing a judgment, and we request that a judgment be made based on this report. We request the rejection of the requests for a new report."

PROSECUTOR REQUESTED 6 YEARS IN PRISON

The representative of the elevator company, A.Y., who was heard as a witness, stated that they did not detect any malfunction in the elevator and that the reason for the elevator stopping could be a voltage drop. After the statements, the prosecutor, who explained his opinion, requested up to 6 years in prison for all defendants for the crime of 'manslaughter by simple negligence.'

HEARING POSTPONED TO MAY 23

The court panel accepted the lawyers' requests for time to defend against the opinion and postponed the hearing to May 23.
