G.D. (37) and D.D. (39), who have two daughters aged 7 and 12 and have been married for 12 years, had a dispute over allegations of infidelity. The woman, who claimed that her husband had cheated on her multiple times, caught D.D. messaging other women on his phone. SHARED FROM HER HUSBAND'S PHONEAfter seeing the messages, G.D. allegedly took D.D.'s phone and posted on her social media account, "I have cheated on my wife many times. I am not sorry because I can look her in the face shamelessly." Following this, the argument at home escalated into a fight. STABBED HIM IN THE TESTICLESAt that moment, G.D.'s mother-in-law, who was present in the house, also got involved in the argument. Later, while G.D. was being assaulted by both her mother-in-law and her husband, she ran to the kitchen and grabbed a knife. During the scuffle, G.D. injured her husband in the testicles. G.D.'s mother, who was upstairs and heard the sounds of the fight, also got involved and took the knife from her daughter's hand. WOMAN ARRESTED AND RELEASEDPolice and ambulance teams were dispatched to the scene. Subsequently, during the police investigation, it was reported that G.D. had injured D.D. with a 27.5 cm knife. Following D.D.'s complaint, G.D. was arrested on December 20, 2024, for intentional injury. During D.D.'s detention process, G.D. was released on December 25, 2024, as a result of an appeal by her lawyer Burak Aylı. "SHE SWUNG THE KNIFE AIMLESSLY TO SAVE HER LIFE"G.D.'s lawyer Burak Aylı stated, "My client learns that she has been cheated on for many years when she goes through her husband's phone. A family dispute arises after she discovers that her husband has been cheating on her repeatedly by renting a house in the district where he works. During this argument, my client is assaulted by her husband. The mother of the man, who hears the sounds of the assault, comes downstairs and gets involved. As a result, the situation escalates into a fight. My client is then assaulted by both her mother-in-law and her husband. At this moment, to protect herself, my client throws an ashtray at her husband. The ashtray hits the other party's shoulder. Then the other party continues to escalate the violence. My client runs to the kitchen to save herself. She grabs a knife from the kitchen. The fight continues again. As a result, my client falls to the ground, and the assault continues from her husband and mother-in-law. To save her life, my client swings the knife aimlessly. At that moment, the knife hits her husband's genital area, causing a cut in his testicles. My client's mother, who lives in the same house, also gets involved and takes the knife from her daughter's hand," he said. "RELEASED WITH THE ADMINISTRATION OF JUSTICE"After D.D. was taken to the hospital, he went to the police station to file a complaint, Aylı reported, "Later, the incident is referred to the judiciary. The incident is reported to the prosecutor's office with a report prepared by the hospital. The prosecutor's office expands the investigation. Our client is referred to the Peace Criminal Court by the prosecutor's office with a request for detention. Unfortunately, in the hearing we attended, my client was unlawfully detained without considering the 'legality' conditions of 'self-defense' and the provisions of 'unjust provocation' that require a lesser penalty. My client is sent to the Marmara Women's Closed Prison. As a result of our appeal on Tuesday, my client was released on Wednesday with the administration of justice, in accordance with the law. The prosecutor's investigation continues. Since our client has no suspicion of fleeing or destroying evidence, we do not think she will be re-arrested in connection with the investigation. We hope that justice will prevail again," he said. "MY CLIENT IS CURRENTLY LIVING IN THE FAMILY HOME WITH HER HUSBAND"Stating that the prosecutor's investigation is still ongoing, Aylı said, "The likelihood that the prosecutor will turn the incident into an indictment and refer it to the court is high. However, we expect the court to also act in accordance with the law, based on the self-defense situation and the reasons for non-punishment under unjust provocation, and if a penalty is to be imposed, it should be at the lowest level. First and foremost, of course, the biggest victim of this domestic violence case is my client, and we expect her to be acquitted, or if not, we expect the decision to be at the lowest level. In cases of injury, if the injury was caused by a weapon, even if the complaining party withdraws their complaint, it becomes a public case. However, the judiciary can evaluate the legality conditions here and may still give an acquittal decision for my client. My client is currently with her two daughters, aged 7 and 12, and has reunited with them. She is currently living in the family home with her husband. During my client's detention process, her mother-in-law and mother took care of the children. Although there was a serious incident of violence within the family, they are together now. I hope that there will be no further problems or fights between them. I wish for an end to the increasing cases of violence against women and domestic violence in our country in recent years," he expressed.
