The trial of Alisya Bahar Candan, who is accused of fraud and membership in a criminal organization, and Gülnihal Çiçek, also known as Nihal Candan, who is facing 8 to 24 years in prison, continued. Tension arose between the imprisoned defendant Bahar Candan and her sister Nihal Candan, who is being tried without detention, during the trial held at the Küçükçekmece 5th Heavy Penal Court.

"I DID NOT DECEIVE NIHAL OR ANYONE ELSE, I REGRET BEING IN THE ORGANIZATION"

Onur Apaydın, the leader of the organization, who said he would sincerely explain what he knows during the trial, said, "As a former police officer, I am ashamed to be in front of you. There are many accusations and allegations against me. No one is as good as they seem, nor as bad as they are told. First of all, a misconception is that I did not deceive Nihal or anyone else who was involved in the case by using the name Kaan Hamzaoğlu and presenting myself as rich. I had businesses called Hamzaoğlu Car Rental and Hamzaoğlu Buffet that I have been operating since 2014. At the same time, I was working as a police officer. My name was written as Hamzaoğlu on my signboard in those years. Everyone, including my family, called me Kaan. Changing the name and surname of a police officer is more burdensome than for other people, so I did not make an application for that. My family situation is not ultra-rich, but I am in a better condition than an average middle-class family. I had about 20 cars in my rental company. All of these cars belonged to my family and me. They were not rented cars. I had to close these businesses because of Ümit Saral's endless demands. I made a living with my police salary until May 2021. I am very sorry and more upset than anyone else for being involved in the Ümit Saral Organized Crime Organization."

"I WAS A PATRIOTIC POLICE OFFICER"

In his defense, Onur Apaydın continued, "I did not get into this system to buy cars cheaply and make money. They portrayed me as a bad person in my previous relationships, but there was no suicide or imprisonment in my previous relationships. If your family is a little rich, you cannot escape from this structure called the Ümit Saral Organized Crime Organization. When I was a police officer, I was a patriotic police officer. I had no problems. 6 months after the operation, an arrest warrant was issued for me, and I didn't even know about it during the 1-year process. No raid was conducted at any of my addresses. I became the leader of the organization when they introduced my ex-girlfriend to the media."

"NIHAL AND BAHAR DID NOT SIT AT THE SAME TABLE WITH ME"

Defendant Apaydın said, "I had no influence on the sale or purchase of cars. I didn't even have any contact with the plaintiffs. I do not accept the charges of being an organization leader and fraud. After the Candan sisters, they called me the organization leader. Let me also tell you where Nihal and Bahar were seen. I had met with someone I knew about the opening of a cosmetic clinic. Through a friend, I was asked insistently to invite Nihal and Bahar Candan. I told them that my relationship with them was bad and they would definitely not come. Unable to resist the insistence through a friend, I called the girls. Bahar and Nihal Candan came. They walked away when they saw me. They didn't even sit at the table. Those who don't know who was at the table. There was no conversation about cheap or expensive cars."

NIHAL WANTED TO LEAVE BY SAYING "I'M TIRED", BAHAR REACTED

Meanwhile, during the ongoing trial, Nihal Candan said that she wanted to go to her grandmother's and that she was tired. Bahar Candan reacted to her sister and grandmother not leaving. In response, Nihal Candan said, "I will never come to this unbalanced girl's trial again."

After the defenses, the court announced its interim decision and decided to continue the detention of the defendants. The trial was adjourned until Wednesday, September 18.

FROM THE INDICTMENT

The indictment prepared by the Küçükçekmece Chief Public Prosecutor's Office included 38 victims, 1 victim suspect, and 21 defendants, including Nihal and Bahar Candan. It was also stated in the indictment that Gülnihal Çiçek, who was in detention, was released under judicial control, taking into account the time spent in detention. The indictment stated that the gang led by Onur Apaydın and İlker Oflu defrauded people by claiming to sell cars cheaply using the carp spiral method. It was noted in the indictment that Bahar and Nihal Candan were part of the hierarchical and organic structure of the criminal organization.

"THEY PLAYED AN IMPORTANT ROLE IN DECEIVING THE VICTIMS DUE TO THEIR FAME"

The indictment further stated, "The suspects had previously participated in various television programs for a long time, and after becoming famous, they also appeared in gossip programs. Due to having a large number of followers on social media platforms, they are referred to as social media influencers and television personalities. Therefore, they are recognized by a wide range of society, and due to this feature, they played an active role in deceiving the victims in special meetings organized by the criminal organization for fraud."

"NIHAL CANDAN WAS IN A RELATIONSHIP WITH THE ORGANIZATION LEADER"

In the indictment, it was stated that Onur Apaydın, the leader of the organization, conducted banking activities through Alisya Bahar Candan, who was in the position of "secret accountant and cash register" within the organization, and that the proceeds of the crime were laundered. On the other hand, suspect Hacı İsrafil Sağlam, who was responsible for providing victims, stated in his statement mentioned in the indictment that he attended organization meetings and said, "Everyone from the upper ranks attended the meetings."

BAHAR'IN 44 NİHAL'İN 24 YILA KADAR HAPSİ İSTENİYOR

İddianamede Bahar Candan'ın 'suç örgütüne üye olmak' suçundan 2 yıldan 4 yıla kadar 'kişinin, kendisini kamu görevlisi veya banka, sigorta ya da kredi kurumlarının çalışanı olarak tanıtması veya bu kurum ve kuruluşlarla ilişkili olduğunu söylemesi suretiyle dolandırıcılık' suçundan ise 2 kez 12 yıldan 40 yıla kadar olmak üzere toplamda 14 yıldan 44 yıla kadar hapisle, Nihal Candan'ın ise aynı suçlardan 8 yıldan 24 yıla kadar hapisle cezalandırılması talep edildi. Öte yandan diğer 20 şüpheli hakkında ise değişen oranlarda hapis cezası istenmişti.
