In Eyüpsultan, a police officer who is alleged to have provided information to the murder suspect of university student Ayşe Tokyaz, whose body was found in a suitcase by the roadside, has had the detention of two defendants continued. The murdered Ayşe Tokyaz's sister, Esra Tokyaz, had previously stated that their statements were leaked to former police officer Cemil Koç.
The university student Ayşe Tokyaz, whose body was found in a suitcase by the roadside in Eyüpsultan, is claimed to have provided information to the police officer accused of her murder. The first hearing of the case, in which two defendants are being prosecuted for "abuse of office" and "illegally providing or obtaining data," with a request for a prison sentence of 3 years and 6 months to 8 years, was held.
THEY APPEARED BEFORE THE JUDGE FOR THE FIRST TIME
At the hearing at the 7th Criminal Court of First Instance in Küçükçekmece, detained defendant police officer N.Ç, non-detained police officer Z.B, complainant Esra Tokyaz, and the parties' lawyers attended.
Esra Tokyaz requested a confidentiality decision, stating that she did not want to disclose her address during the identification process.
During the hearing, defendant N.Ç, who was defending himself, stated that he had worked with the suspect Cemil Koç at the Diyarbakır Provincial Police Department in 2016-2017, and that Koç called him the Friday evening after the incident, asking, "Are you working?" and hung up after he answered.
"CEMIL TRIED TO USE ME"
The defendant stated that Koç called him again the next day, asking if he would come to Istanbul, and he replied, "No." He continued, "He called me again half an hour later. He insisted that I ask for permission. I became suspicious. I thought he was involved in an incident. While I was working, he asked me to look at a file. He was involved in a shooting incident, and I did not provide any information. He complained that I was not looking at it and hung up. Cemil tried to use me in this incident."
"I DID NOT CALL TO PROVIDE INFORMATION"
N.Ç claimed that he learned about the incident from the news when he went to work on Monday evening, and he noted: "After seeing it on the news, I did not call Cemil to ask anything about the incident. He told me that he got engaged to Ayşe Tokyaz 5 months ago but did not provide any details. He asked me, 'Is there anyone we work with in Istanbul?' I said no. When he called me, he was either calling me to come to Istanbul or asking about a familiar police officer.
Since I was not at my workplace, I gave Z.B, who was at work, Cemil's ID number and had him check. Z.B. sent me a photo of the paper showing a summary of the incident he was involved in. He was a fugitive from this file. I did not call Cemil to provide information. Cemil called me again. He asked when I would go to work. I do not have a screen in POLNET or any other system where I can see Esra Tokyaz's statement. I did not read the statement; I only saw that she was a complainant. I am requesting my release."
Non-detained defendant Z.B. stated that he was the only one in the unit because it was the weekend, and while he was about to leave the branch, defendant N.Ç called him and asked him to conduct a query through POLNET.
Z.B. reported that when he provided his own information and searched for Cemil Koç in this system, he saw that he was involved in the murder. He claimed that he did not see Esra Tokyaz's defense on the screen.
AYŞE TOKYAZ'S SISTER SPOKE
The sister of the deceased Ayşe Tokyaz, complainant Esra Tokyaz, also stated that her previous statement was given to Cemil Koç by the defendants.
Tokyaz expressed that she believed the defendants helped in placing the victim in the suitcase and claimed that they prevented the defendants from reaching her brother.
The court, announcing its interim decision, ruled for the continuation of the detention of police officer N.Ç. The court postponed the hearing to address the missing issues. The victim's sister Esra Tokyaz made statements in front of the courthouse after the hearing.
IT WAS ALLEGED THAT THE POLICE LEAKED INFORMATION
Esra Tokyaz, the sister of university student Ayşe Tokyaz (22), whose lifeless body was found in a suitcase by the roadside in Eyüpsultan after being murdered on July 11, stated that their statements were leaked to former police officer Cemil Koç.
Esra Tokyaz also mentioned that Cemil Koç had subjected Ayşe to violence for a long time and had held her captive, and that they had reported this situation to the authorities multiple times.
WHAT DOES THE INDICTMENT CONTAIN?
The indictment prepared by the Küçükçekmece Chief Public Prosecutor's Office states that an investigation was initiated upon the complaint of Esra Tokyaz, indicating that her sister, the deceased Ayşe Tokyaz, was forcibly held and subjected to violence by former police officer defendant Cemil Koç.
The indictment notes that after the body of the deceased Ayşe Tokyaz was found in a suitcase in a green area in Eyüpsultan on July 13, the statement of complainant Esra Tokyaz was taken.
It is stated in the indictment that the suspect Cemil Koç, who is accused of killing Tokyaz, contacted complainant Esra Tokyaz via WhatsApp on July 12, indicating that he was aware of the statement she had given, and that an investigation was initiated to identify those who shared the information with the defendant.
As a result of the investigations, the indictment reveals that access was obtained from the screen belonging to police officer defendant N.Ç, who was working at the Malatya Narcotics Crime Investigation Branch, through the "Polnet-4" system.
The indictment states that the defense of defendant N.Ç, claiming that he did not send the document regarding the summary of the incident sent to him by the other defendant Z.B. to suspect Cemil Koç and did not provide information about the incident, is aimed at evading the crime and cannot be taken seriously.
The indictment describes how defendant N.Ç, at the request of his friend, former police officer and suspect of intentional murder Cemil Koç, had Z.B. conduct an inquiry, and that he provided information to Koç from the incoming report, thus unlawfully accessing and sharing the report. It is stated that defendant Z.B. participated in the act by conducting the inquiry and sending a photo of the document at the direction of defendant N.Ç.
It is also recorded in the indictment that the defendants acted contrary to the requirements of their duties by providing information to suspect Cemil Koç, thus abusing their positions, and that the existing evidence is sufficient to create reasonable suspicion. The indictment requests that police officers N.Ç. and Z.B. be sentenced to imprisonment of 3 years and 6 months to 8 years for "abuse of office" and "illegally providing or obtaining data."
