The Ministry of Treasury and Finance has prepared a new regulation to combat tax evasion. The defense of "I used the fake document unknowingly" will no longer be valid; it will be based on the premise that it was "knowingly used." Those who use fake documents will face 3 to 8 years of imprisonment and a threefold tax penalty. Special measures will be taken for high-risk companies, and precautionary seizures will be implemented for those who cannot provide collateral. The regulation will come into effect on October 1st.
The Ministry of Treasury and Finance has prepared a new regulation to prevent tax evasion. Accordingly, the defenses of companies claiming they "used fake documents unknowingly" will no longer be considered valid. It will be assumed that the document was "knowingly used," and those who use fake documents will face prison sentences ranging from 3 to 8 years.
COMES INTO EFFECT ON OCTOBER 1
According to a report by Sabah, the regulation prepared by the Presidency of the Tax Audit Board (VDK) will be implemented starting from October 1. With the new application, taxpayers using fake documents will face a tax loss penalty of three times the amount, and actions will be taken under tax evasion.
ADDITIONAL MEASURES ON THE WAY
Special measures will be taken for companies with a history of fake document risks. Precautionary seizures may be applied to taxpayers who cannot provide collateral. Additionally, the authenticity of transactions will be analyzed through the VDK's Organization Supervised Analysis (KURGAN) System.
THOSE USING FAKE DOCUMENTS WILL BE MONITORED
Taxpayers deemed risky will be subject to field audits. They will be asked to show the goods in their warehouses, present sales documents, and disclose production records. Direct actions will be taken against those found to be using fake documents.
MONEY LAUNDERING ASPECT IS ALSO ON THE AGENDA
The Tax Audit Board will also report cases with past suspicions of fake documents in writing. This will provide taxpayers with the opportunity to correct their records. Those who issue fake documents will be investigated under money laundering regulations.
