After the Constitutional Court's annulment of indefinite alimony, attention has turned to how the process will proceed from here. According to the Constitutional Court's decision, the Parliament will enact a new law on this matter within 9 months. Nurettin Alan, a member of the TBMM Justice Commission and AK Party Istanbul Deputy, evaluated the annulment decision for Haberler.com.

Following the Constitutional Court's annulment of indefinite alimony, attention turned to new regulations, and a striking statement came from the AK Party. Nurettin Alan, member of the TBMM Justice Commission and AK Party Istanbul Deputy, evaluated the annulment decision for Haberler.com Ankara Representative Şerife Güzel.

Alan stated that alimony has not been completely abolished, only its indefinite application has been ended, and announced that they will work on new legislation that considers the rights of women, men, and children.

"IT SHOULD NOT BE PERCEIVED AS THE BEGINNING OF A NO-ALIMONY ERA"

Nurettin Alan reminded that the issue of indefinite alimony has been debated in society for about 10 years, saying, "Marriages lasting 1-2 months or even a year resulting in lifelong alimony truly causes problems for social peace."

Alan emphasized that the AYM's annulment decision should not be perceived as "the beginning of a no-alimony era," stating, "What was annulled is the duration of poverty alimony. It annulled the indefinite part of the alimony that the faultless spouse can receive, which we call poverty alimony due to the end of the marriage. It did not abolish alimony, but annulled its indefinite part."

"WE WILL CONDUCT LEGISLATIVE WORK"

Noting that legislative work will be carried out within the framework of the AYM's annulment decision, Alan said, "We will make a new regulation regarding this alimony while protecting social peace, tranquility, and women's rights, men's rights, family rights, and children's rights. Of course, they gave 9 months. In fact, work on these issues was already underway in our Parliament. Both coincided with the same period."

"THE OLD LAW WILL REMAIN VALID UNTIL THE NEW LAW IS ENACTED"

Nurettin Alan stated that during the 9-month period given by the AYM, the old law will remain valid until the new law is enacted, saying, "So, we have a 9-month period ahead. There is no 'we will wait for 9 months' situation. We will hopefully carry out a study within that period and make our regulations regarding this."

WILL THE NEW LAW BE READY BEFORE PARLIAMENT'S RECESS?

Alan pointed out that it is difficult for the new law study to be completed before Parliament goes into recess, evaluating, "My opinion is that it will be postponed until after Parliament's recess. Considering the 9 months given by the Constitutional Court, there is no emergency."
