A citizen who paid by credit card during a vehicle inspection in Tokat objected to the commission fee charged. The Consumer Arbitration Board ruled that no commission can be charged for credit card payments and decided that the amount collected should be refunded by TÜVTÜRK. However, TÜVTÜRK's headquarters responded to the citizen, stating, "the fee will not be refunded, and if desired, legal action can be taken."

A citizen who objected to the commission fee charged for a payment made by credit card during the vehicle inspection in the Niksar district of Tokat obtained a precedent-setting decision from the Consumer Arbitration Committee.

CONSUMER ARBITRATION COMMITTEE: AGAINST THE REGULATIONS

After the incident, Ali Kaya applied to the Consumer Arbitration Committee with the payment receipt. The committee reviewing the application evaluated it under Article 17 of the Law on the Protection of Consumers No. 6502 and the Credit Cards Law. The decision emphasized that member businesses cannot demand a commission or additional service fee from consumers for payments made by credit card. The committee unanimously ruled that the 65.63 TL charged due to the credit card payment was against the regulations and decided that the amount should be refunded to the consumer by TÜVTÜRK.

"I WAS AFRAID OF ENFORCEMENT COSTS"

Describing the process, Ali Kaya stated that he had to pay a commission during the inspection, saying, "I said that no commission should be taken, but I had to pay. Later, I applied to the Consumer Arbitration Committee and was found right. When I spoke with the TÜVTÜRK headquarters, I was told that the fee would not be refunded and that I could take legal action if I wanted. I did not choose this path due to the concern that the enforcement costs would fall on me," he expressed.
