34 students who were detained during the protests that began with the arrest of Istanbul Metropolitan Municipality (IBB) Mayor Ekrem İmamoğlu, who was suspended from duty in the investigations conducted against IBB by the Istanbul Chief Public Prosecutor's Office, have been released.
The Istanbul 70th Criminal Court of First Instance accepted the indictment prepared with a request for imprisonment of 6 months to 3 years for 49 defendants on the charge of "violating the Law on Meetings and Demonstrations." The court, which examined the petitions of the defendants' lawyers regarding the release of their clients, noted the nature and characteristics of the crime attributed to the defendants, considering the minimum and maximum penalties specified in the law, and stated that the crime was not among the catalog crimes.
The court evaluated the current evidence situation, the duration of the defendants' detention, the fact that the defendants have fixed residences, and that there is no suspicion of flight, and stated that the contents of the objection petitions submitted regarding the continuation of the detention decision given by the preliminary ruling were taken into account. Emphasizing that the defendants have the right to a fair trial, the court noted that considering these matters, the release of the 34 detained defendants from the charges against them was decided separately.
THE NUMBER OF RELEASES INCREASED TO 93
The Istanbul 62nd Criminal Court of First Instance had previously issued a release decision for 59 young people who were detained on the grounds of participating in the March 19 protests. Thus, the number of released young people has risen to 93.
