The family of mathematics teacher Ayla Kara, who lost her life in the armed attack carried out by 14-year-old İsa Aras Mersinli at Ayser Çalık Middle School in Kahramanmaraş, filed a lawsuit for 5 million 100 thousand liras in material and moral damages against the suspect's detained father, Uğur Mersinli. Özcan Kara, the family's lawyer, stated that along with the lawsuit, a precautionary attachment order was placed on all of Mersinli's assets by court decision.
In the attack carried out by İsa Aras Mersinli on April 15 in Kahramanmaraş, using his detained father, police chief inspector Uğur Mersinli's guns, at Ayser Çalık Middle School, 9 students and 1 teacher lost their lives. While the investigation into the incident was completed and a criminal case was filed, the family of the deceased mathematics teacher Ayla Kara also filed a separate compensation lawsuit.
'PARENTS MUST COMPENSATE ALL MATERIAL AND MORAL DAMAGES OF THE VICTIMS' Ayla Kara's family applied for a precautionary lien to be placed on all of Uğur Mersinli's assets. The Kahramanmaraş 9th Civil Court of First Instance, which evaluated the application, accepted the family's request and decided to place a precautionary lien on all of Mersinli's assets. In the justification of the decision, the judge stated that according to the Turkish Civil Code, parents are materially and morally responsible for the damages their children cause to third parties, and that in the established precedents of the Court of Cassation, a child under the age of 15 being driven to a crime of this magnitude resulting in murder, or having access to firearms or sharp objects, is considered a lack of familial supervision, education, and oversight, adding, 'In summary, due to a murder committed by a child under 15, the parents may not receive a prison sentence, but they are obliged to compensate all material and moral damages suffered by the victims' relatives from their own assets.'
'WE FILED A LAWSUIT FOR 5 MILLION 100 THOUSAND LIRAS' Following this decision, the family filed a material and moral compensation lawsuit of 5 million 100 thousand liras against Uğur Mersinli at the Kahramanmaraş 4th Civil Court of First Instance. The family's lawyer, Özcan Kara, who is also Ayla Kara's brother-in-law, stated that as a family, they will fight legally to ensure that those responsible for the attack receive the harshest punishment. Özcan Kara said the following:
"Following the indictment of the April 15 school attack, we also started our legal struggle on behalf of our clients, the family, spouse, and children of the martyr teacher Ayla, and we applied to the Kahramanmaraş 9th Civil Court of First Instance for a precautionary lien order to be placed on all assets of the suspect Uğur Mersinli. The court accepted our request, issued a precautionary lien order, and a precautionary lien order has been placed on all assets of the suspect Uğur Mersinli. We subsequently filed the compensation lawsuit. The compensation case will proceed at the 4th Civil Court of First Instance. At this stage, we filed the lawsuit for 5 million 100 thousand liras. Of course, in the later stages, since these material damages will be revealed through expert reports, it is possible for us to increase the claim through case amendment. Once the damage is fully determined, we will continue the case based on that amount."
THEY WILL FACE THE JUDGE ON SEPTEMBER 4 Within the scope of the investigation conducted regarding İsa Aras Mersinli killing teacher Ayla Kara and students Adnan Göktürk Yeşil, Almina Ağaoğlu, Bayram Nabi Şişik, Belinay Nur Poyraz, Furkan Sancak Balal, Kerem Erdem Güngör, Yusuf Tarık Gül, Zeynep Kılıç, and Şuranur Sevgi Kazancı, the detained father Uğur Mersinli and mother Peyman Pınar Mersinli will face the judge for the first time on September 4. In the case to be heard at the Kahramanmaraş 3rd Heavy Penal Court, Uğur Mersinli will be tried with 10 life sentences for the crime of 'Olası kastla öldürme' and up to 30 years for 'Olası kastla yaralama', while Peyman Pınar Mersinli will be tried with a request for up to 22.5 years in prison for the crime of 'Bilinçli taksirle birden fazla kişinin ölümüne ve yaralanmasına neden olma'.
