New Party Chair Özgür Özel, stating that they want to visit former Minister of Family and Social Services Fatma Betül Sayan Kaya, who was arrested within the scope of the fund investigation, in prison, said: "We are going to visit everyone who has been arrested. If permission is granted and she accepts, we would also like to visit Fatma Betül Sayan Kaya."
A new development has occurred regarding former Minister Fatma Betül Sayan Kaya, who was arrested as part of the fund investigation conducted on charges of opposing the Capital Markets Law and "membership in an organization established for the purpose of committing crimes." Özgür Özel, Chairman of the New Party, stated in an interview with Saygı Öztürk of Sözcü newspaper that they had visited those arrested within the scope of the investigation and expressed that they were ready to take a similar step for Kaya as well.
"WE WOULD LIKE TO VISIT HER"
Özel, conveying that party delegations had met with many people detained within the scope of the fund investigation, said, "We are going to visit everyone arrested. We would also like to visit Fatma Betül Sayan Kaya if permission is granted and she accepts. At the moment, our friends have met with many people detained in this fund matter, and they continue to meet with them. I suppose we have not yet evaluated this matter with the committee members regarding Ms. Fatma either, but we will assign someone for that as well."
"IF THERE ARE THINGS SHE COULDN'T SAY..."
Emphasizing the importance of the presumption of innocence in the legal process, Özel stated that they could act as an intermediary if there were matters Kaya wanted to make public, and used the expressions, "Under normal circumstances, the presumption of innocence is very important; we always remind this. If Ms. Fatma thinks that she cannot say certain things, if she says them, we will share this openly."
WHAT ARE THE CHARGES AND ALLEGATIONS?
According to information in the investigation file, it was alleged that the Kaya couple obtained unfair gains in one of the funds liquidated by the CMB. It was also alleged that İbrahim Ömer Gönül, former Chairman of the CMB and Chairman of the Public Oversight, Accounting and Auditing Standards Authority, abused his office in relation to the rapid rise in the funds, and the Ministry of Treasury and Finance granted permission for an investigation into the allegations. Gönül was removed from his post on October 19.
DETAILS OF THE REFERRAL DOCUMENT HAVE EMERGED
The technical and legal details in the committal document prepared for Fatma Betül Sayan Kaya's arrest have come to light. The findings in the referral document were listed as follows:
- Finding of Insider Information: In the CMB report examining the data on the shares of Özata Denizcilik San. ve Tic. A.Ş. (OZATD), it was stated that Kaya possessed non-public information of a nature that could affect the value of the capital market instrument and investors' decisions.
- Tera Group Concentration: When the KAP data and capital structure were examined, it was recorded that Tera Group made a large amount of purchases in OZATD shares at the company and fund level. It was reported that in Kaya's statement, she declared that she had a long-standing acquaintance with Erdin Özel, one of Tera Group's managers, that the meetings intensified during the investment process, and that she also met with Emre Tezmen, Chairman of Tera Group's Board of Directors.
- Sale One Day Before the Liquidation Decision: It was stated that the rise in OZATD shares began in April 2026, and the liquidation decision was taken on September 17, 2026. It was determined that Kaya sold the shares she bought in April on September 16, 2026, exactly one day before the liquidation decision.
- Special 'T+0' Privilege and Transfer Transaction: It was recalled that, under normal circumstances, sales transactions on the stock exchange are subject to the 'T+2' rule, meaning the money passes to the account after 2 business days. However, it was determined that the shares belonging to Kaya were not sold on the market but were transferred to Tera Yatırım Menkul Değerler A.Ş. by way of transfer, and in a 'T+0' position, the share price was transferred to the suspect's account on the same day.
In the referral document, it was included in the assessment that Kaya, despite making a stock exchange investment for the first time, carried out high-value transactions and acted in dialogue with Tera Group managers, knowing in advance the share price movement range and that the liquidation decision would be taken.
