A terrible incident occurred in Maltepe, Istanbul, in September 2021. A graphic designer woman, B.A. (23), met with her friend Baha S. Baha S. introduced her friend to another female friend, musician D.A. The friendship of the three friends progressed, and they stayed at D.A.'s house for a few days. On the day of the incident, Baha S. said he had invited two male friends to the house. Although the young girls objected to the situation, Erhan Ş. and Yücel K. came to the house.
THEY WENT IN AND OUT OF SLEEP AND FAINTING
According to allegations, the young girls fell asleep strangely before the two men arrived. According to a report by the Sabah newspaper, the reason for the strangeness would later become clear. At one point, B.A. woke up and saw her friend Baha S. on top of her. She realized she had been sexually assaulted but fainted again. When she woke up this time, she noticed that Erhan Ş. had sexually assaulted her. Her consciousness was a bit clearer. She pushed the attacker and screamed. Then she fainted again. When she woke up, she realized she was naked and that Yücel K. had dressed her. The other woman sleeping next to her was also half-naked.
"IT WAS YÜCEL WHO HAD INTERCOURSE WITH YOU"
When B.A. came to, Erhan Ş. and Yücel K. were not at home. Baha S., who remained at home, denied the sexual assault allegations, claiming they were dreaming. When the women pressed her, she said, "It was Yücel who had intercourse with you." The two women who went to the police station filed a complaint. D.A. added that after waking up, her upper body was completely naked, and her shorts were down a bit below her hips, and she remembered nothing about the night after falling asleep.
THE SUSPECTS DENIED
Erhan Ş., who turned out to be married, claimed in his statement that he was falsely accused, stating that he kissed the women with their consent but did not have any sexual relations. Another suspect, Yücel K., also denied the allegations but mentioned that he saw B.A. naked and told her to get dressed. Baha S. claimed that they were crowded at home during the incident but did not call their friends named Erhan and Yücel. The suspects were released.
NOTABLE DETAILS IN THE INDICTMENT
The Anadolu Chief Public Prosecutor's Office completed the investigation. The prepared indictment included notable details. The prosecution stated that the three friends consumed alcohol together on the day of the incident, and that suspect Baha called his friends Erhan and Yücel, after which the two women fell asleep. It was noted in the indictment that when B.A. woke up, she saw that her friend D.A. had been sexually assaulted by Baha, and that she fell asleep again and later realized she had been sexually assaulted. It was reported that B.A. was semi-conscious when she woke up and saw the suspects Baha, Erhan, and Yücel next to her in turn each time she woke up.
QUALIFIED SEXUAL ASSAULT CASE
The prosecution noted that the suspects were found to have committed sexual assault against the complainant women and emphasized that the complainants were assaulted according to the Forensic Medicine Institution report. It was requested that all three suspects be sentenced to a total of at least 24 years in prison for the crime of "qualified sexual assault" against the two women separately. The court determined that defendants Baha and Erhan were already in prison for other crimes and requested a letter to be sent to the prison to ensure their presence in the courtroom on the day of the hearing. A letter was also sent for the other defendant Erhan to appear in court.
"I FELT LIKE I WAS PARALYZED"
While B.A., one of the victims, was filing a complaint, she stated in an interview with Sabah, "I was unconscious during the collective sexual assault. I am sure they made me drink something against my will. I felt like I was paralyzed. I think they gave me medication. When I woke up, I realized what had happened to me. I am receiving psychological treatment. But I will not give up on my fight for justice. I fear that other women may also become victims. I want them to receive the heaviest punishment and for the trial to begin," she said.
