Following President Recep Tayyip Erdogan's directive to "accelerate efforts" during the AK Party Central Executive Committee meeting, the pace of legal work on the Terror-Free Turkey process has increased. According to information obtained by Haberler.com, legal aides are intensifying their work on the draft, and it is increasingly likely that the regulation will be brought to the agenda before the Turkish Grand National Assembly goes on recess, possibly requiring the Assembly to work during August.
The recent spate of consecutive contacts and the acceleration of legal framework studies by legal staff have strengthened the possibility that the legal regulation regarding the Terror-Free Turkey process will be brought to the parliamentary agenda before the recess.
“EXPEDITE” MESSAGE AT THE LAST CEC MEETING
According to the report by Haberler.com Ankara Representative Şerife Güzel; AK Party officials expressed the view that sufficient progress has not been achieved on the ground following the image of disarmament, and that the terrorist organization PKK has been slow in evacuating caves and handing over weapons, saying “there will be no legal regulation when no adequate step has been taken on the ground.” Although AK Party officials stated that the possibility of introducing a legal regulation was not very feasible due to the slow pace of developments on the ground, legal staff had nevertheless begun work on the legal regulation. It was noted that the final shape of the work could be given depending on the progress of the process. The studies, ongoing for some time, accelerated following President Erdoğan's directive at his party's latest Central Executive Committee (CEC) meeting.
PARLIAMENT MAY WORK IN AUGUST FOR THE PROCESS LAW
Among AK Party officials, the view was expressed that the legal regulation could be submitted to Parliament before the recess, but its discussions could take place in October at the start of the new legislative year. However, after TBMM Speaker Numan Kurtulmuş's meeting with the DEM Party Imrali delegation, and following President Recep Tayyip Erdoğan's reception of TBMM Speaker Numan Kurtulmuş, the view began to be voiced that “Parliament may not close at the end of July. It could work in August for the discussions on the law.”
LEGAL STAFF ACCELERATED WORK
Meanwhile, after Erdoğan's remarks at the CEC about “accelerating the law study,” legal staff intensified their work on the draft. Legal staff working on the issue initially considered two-stage alternatives: first, enacting a framework law containing only provisions that would benefit organization members not involved in crimes, and later making arrangements regarding the situation of organization members involved in armed actions. However, with the recent momentum, comments have re-emerged that “it may come as a single law, not in two stages.”
CRITICAL QUESTION: WHICH INSTITUTION WILL CONDUCT CONFIRMATION AND DETERMINATION?
A matter on which the legal staff working on the issue are meticulously focused is how the “confirmation” and “determination” regarding members of the armed terrorist organization having laid down their weapons and ceased organizational activities will be carried out. Detailed work is ongoing on which institution will make this determination and through what process. The confirmation and determination process is being considered to be conducted by the National Security Council. Another point of emphasis is what kind of duties will be assigned to which institutions in the execution of the process, and how the structure of the “board” that will monitor the process will be established.
WHAT PROCESS AWAITS INCOMING ORGANIZATION MEMBERS?
An important aspect of the process is what kind of procedure will be applied to organization members who will come to Turkey after the legal regulation passes through Parliament. The prepared “framework law” draft will address this issue in detail. According to the studies, for organization members to benefit from execution processes and probation according to the crime they committed, it will be determined with concrete evidence that armed activities have completely ended and the organizational ties have been severed. In order for this decision to be made, it will be clearly declared that violence-based activities have ceased and that organizational activities will not be resumed. Additionally, participation in a social integration program will be mandatory. Each organization member's application will be evaluated separately.
THOSE IN PRISON WILL ALSO BENEFIT
The execution conditions that will benefit organization members in the mountains will also apply to those under investigation and those currently in prison.
